ILGA Special Session Aug 17

With Shepherd coming down most likely on the 8th or so, I wonder if this session would be co-opted to deal with the lack of UUW/AUUW that IL is going to be left with after the decision.

The Sheperd decision shouldn't even be on our minds right now since it's just another link in the chain.
Even if it's in our favor, it will little to no effect on what's going on in Springfield in the immediate future.

Yes. I'm predicting that Chicago/Cook county will be sold out in order to get "shall issue".

Because the state will ask for a stay and appeal?
I think a favorable ruling could affect legislation in the near future because a few legislators will see the writing on the wall and will be willing to deal in a CCW bill.

how do you figure that? With the Maryland win last week and a win here in the 7th, how will an appeal by Lisa madigan be successful? the Supreme court is the next step and with two Fed Appeals court ruling the same, the chances that the Supreme Court will accept an appeal are slim to none.
If the 7th comes out with an injunction against the UUW/AUUW statue, you will see a massive panic among the Chicago reps/senators in the ILGA.
Seriously, the legalization of dueling would end political pandering and solve political corruption in the State

Yes. I think we may need to play defense if they open up the topics in this special session. It would be just like them to try to sneak through a mazagine ban.

We still have nothing but "ifs", "maybes" and "should"
An appeal is all but guaranteed no matter who the ruling favors, leaving us with another link forged in the chain.
Unless the ruling compels the state to vacate all uuw convictions and grants relief on same, it's not going to have any real effect since an injunction is far less certain. Not really square one, but not a huge step forward.
This may make things warm for the state, but unless they face huge losses in this, they'll just continue the fight.
The risk has to be too great for the Madigan clan to take. We need other avenues of pressure to dissuade their pursuit of this beyond where it is.
I always point to the money. If the people knew the cost of these cases we'd win more converts if for no other reason because of how many schools, roads and police/fire stations won't be built and how many educators will loose their pensions because of the politics of the Madigans. In an election year, they'll definitely feel that kind of heat.

I'm not an authority on exactly all that is going on, but I'll do my best.
Back in June both sides made arguments as to whether or not carrying is a constitutional right outside the home. The ruling by the 7th will be made on or around August 7th. It they rule in our favor it will get appealed by the State and the court battle will continue. It could pressure some on the fence to work with our side in the legislature. That would be the fastest track to gaining the right to carry in IL. If you listen to these oral argument you'll be able to easily make your own opinion about where we are at in the court battles.

Madigan wouldn't bring the legislative bills up for a vote prior to the summer recess. I'm hoping the Judicial process via a favorable decision by 7th will pressure him into allowing the legislative process to function and take the vote 'for the people'.
Here is a good place to start if you want to get up to speed with the up coming decision.

I was thinking of the BGA. Though half the time they seem to be kissing the government's a$$ as much as kicking it.

Thanks for the info. Does this mean that even if the 7th Circuit Court of Appeals votes in favor of the CCW bill that it could still take several years for us to see it since the state will appeal it? It sounds like this could just get buried by means of repeated appeals, or at least stall it for years to come.

If the 7th rules unfavorably for us it will go to SCOTUS and be ruled on sometime in 2013 I believe.

The 7th Circuit is not ruling on a CCW bill, they are ruling if the UUW and AGUUW laws are constitutional. If they overturn those laws, there will be none that prohibit carrying a gun, concealed or otherwise, that SHOULD send the legislators scrambling to pass some kind of law to regain control.
I'm sure they will appeal and ask for a stay, if they get the stay, nothing will change until the supreme court rules. But it may pressure them into passing some kind of CCW bill.
