HB5151 - Premises Liability Firearm Range makes its debut on the House calendar today at second reading.  I have coded this bill as green/good.

HB5167 - Ammunition Tax and HB5831 - FOID Handgun Registration were passed in committee yesterday but are not yet on the calendar.

House Floor Amendment No. 2

Replaces everything after the enacting clause. Creates the Family and Personal Protection Act. Provides that the Department of State Police shall issue a license to carry a loaded or unloaded handgun to an applicant that meets specified qualifications, has provided the application and specified documentation, and has submitted the requisite fees. Provides that a license to carry a handgun entitles a licensee to carry a loaded handgun, either concealed or openly, on or about his or her person or in a vehicle, except in certain prohibited locations. Provides that the license shall be issued by the Department of State Police within 45 days of receipt from a sheriff and shall be valid throughout the State for a period of 5 years from the date of issuance. Provides for renewal of licenses. Establishes qualifications for licensees, certified firearms instructors, and instructor trainers. Provides that it is declared to be the policy of the State that it is an exclusive power and function of the State to regulate the possession and transportation of handguns and the issuance of licenses to carry handguns. Provides that with certain exceptions a home rule unit shall not regulate the possession or transportation of handguns. Provides that a home rule unit shall not regulate the number of handguns or require registration of handguns possessed by a person licensed under the Act. Provides that the provisions of the Act are severable. Amends the Freedom of Information Act. Prohibits from inspection and copying information about applications for licenses to carry a handgun and about license holders contained in the database created by the Family and Personal Protection Act, except as authorized by that Act. Amends the State Finance Act. Includes the Citizen Safety and Self-Defense Trust Fund as a special fund in the State treasury. Amends the Criminal Code of 1961. Provides that the statute concerning unauthorized possession or storage of weapons does not apply to a person acting lawfully under the Family and Personal Protection Act. Provides that certain unlawful use of weapons provisions relating to unlawful use of a weapon do not apply to or affect a licensee who has been issued a license to carry a handgun under the Family and Personal Protection Act, notwithstanding the provisions of that Act prohibiting the carrying of a handgun in certain places.

House Floor Amendment No. 3

Changes references from "handgun" and "weapon" to "concealed firearm". Provides that a concealed firearm licensee who is prohibited from carrying a concealed firearm in certain places shall be permitted to store that handgun or ammunition out of plain sight in a locked vehicle or within a locked compartment or container within his or her vehicle. Provides that a licensee shall not be in violation of the Family and Personal Protection Act while he or she is traveling along a public right of way that touches or crosses any of the prohibited premises if the handgun is carried on his or her person in accordance with the provisions of the Act or is being transported in a vehicle by the licensee in accordance with all other applicable provisions of law. Adds an immediate effective date to the bill.

HB1294 - Crim Cd Assault Weapons Prohibited

Synopsis As Introduced

Amends the Criminal Code of 1961. Provides that 90 days after the effective date of this amendatory Act, it is unlawful for any person within this State to knowingly manufacture, deliver, sell, purchase, or possess or cause to be manufactured, delivered, sold, purchased, or possessed a semi-automatic assault weapon, an assault weapon attachment, any .50 caliber rifle, or .50 caliber cartridge. Provides that beginning 90 days after the effective date of this amendatory Act, it is unlawful for any person within this State to knowingly manufacture, deliver, sell, purchase, or possess or cause to be manufactured, delivered, sold, purchased, or possessed a large capacity ammunition feeding device. Provides that these provisions do not apply to a person who possessed a prohibited weapon, device, or attachment before the effective date of this amendatory Act if the person has provided proof of ownership to the Department of State Police within 90 days after the effective date of this amendatory Act. Provides that on or after the effective date of this amendatory Act, such person may transfer such device only to an heir, an individual residing in another state maintaining that device in another state, or a dealer licensed as a federal firearms dealer. Specifies penalties for violations. Provides exemptions. Provides that the provisions of the Act are severable. Effective immediately.





HB1599 - Crim Cd Assault Weapons (Increased Penalties)

Amends the Criminal Code of 1961 relating to unlawful use of weapons. Increases the penalties by one class if a semi-automatic assault weapon or high capacity ammunition was possessed in the commission of the offense. Defines "semi-automatic assault weapon" and "high capacity ammunition". Effective immediately.



HB1855 - Firearm Owners Loss Theft

Amends the Firearm Owners Identification Card Act. Provides that the Department of State Police may revoke and seize a Firearm Owner's Identification Card previously issued under the Act of a person who fails to report the loss or theft of a handgun a second time to the local law enforcement agency within 72 hours after obtaining knowledge of the second loss or theft. Amends the Criminal Code of 1961. Provides that if a person who possesses a valid Firearm Owner's Identification Card and who possesses or acquires a handgun thereafter loses or misplaces the handgun, or if the handgun is stolen from the person, the person must report the loss or theft to the local law enforcement agency within 72 hours after obtaining knowledge of the loss or theft. Effective immediately.




HB5151 - Premises Liability Firearm Range

Amends the Premises Liability Act. Provides that an owner or operator of a firearm range placed in operation after January 1, 1994 is immune from criminal liability and is not subject to any action for public or private nuisance or trespass arising out of or as a consequence of noise or sound emissions resulting from the normal use of the firearm range if: all areas from which a firearm may be properly discharged are at least 500 (rather than 1,000) yards from any occupied permanent dwelling on adjacent property; or the firearm range met those requirements at the time the range began its operation and subsequently an occupied permanent dwelling on adjacent property was built within 500 (rather than 1,000) yards from an area of the range from which a firearm may be properly discharged. Effective immediately.

Had Senator Kotowski's bill, SB3218 - Crim Cd Gangs No Firearm found sufficient support in the Criminal Law Committee yesterday it likely would be on the calendar at second reading today.  As has happened in the past, however, the Senator's desire to make untrained citizens responsible for law enforcement met with failure, leaving nothing to report for the Senate today.

I have very little sympathy for Senator Kotowski's loss.  VERY little.  In fact, so little, it can't even be measured!!  I heard last night the he was more than a little upset.   Good for him.

This may be off topic but I was trying to figure out what HB5831 - FOID Handgun Registration means, I did the witness slips to oppose it and read the synopsis but am a little unclear of the law as written.  The way I read is that all handguns now have to have a slip of registration?

Simply a handgun registration bill.

The bill has not been made law so no, handguns are not subject to State registration at this time.  

House Amendment No 2 to HB5831 was filed today.  I haven't had a chance to read it all, but it still apears to be a "per handgun" registration scheme and fee.

In regard to Amendment No 2, I do note that the proposed change to a $20 per gun tax is not included in the wording.  

Not that the amount of the tax would make this bad piece of legislation any better, but if approval of Amendment No 1 is not pursued then their talk of a $20 tax  instead of $65 is nothing more than talk.

And now we have House Amendment No 3 to HB5831 whihc does include wording relative to a $20 tax.  I feel like I'm trying to follow the little ball under the cups.

This sounds like a way to get a list of gun owners, now that the FOID list is off limits. If there ends up being a registration, I would like to see that information kept private as with the FOID info.

I wrote my representative, Michelle Mussman(56th District)and asked her how she would vote on these assorted bills if they came up for a vote. If I don't get the right answer it's going to be extremely tough for me to stay civil if I go to her office at IGOLD<deep cleansing breaths, relax>.
