  2. Not directly, it has to go through the 7th first. Where Bevis is the binding precedent.
  3. Bevis and Friedman, which are now binding precedent in this circuit, are the final nails in our coffin in this state - what a shame. I imagine this order is going to be exactly how mcglynn rules as well, he can't simply ignore what the 7th Circuit has already done
  4. Please don't read too much into this! The process has to play out before the Supreme Court jumps in. Also, remember that this is only about an injunction, not the merits of the case.
  5. Yes, they gave easterbrook a way out that allows him to save face. I'm doubting that easterbrook takes Plaintiff’s offer, but it is a nice addition to the brief nonetheless!
  6. Unless I totally missed it, easterbrook's Friedman case isn't even cited by the state. Interesting.
