  1. It was a little more than complaining. The law and JCAR actually changed to specify that licensees should not lose time. But even after the law changed, ISP still renewed licenses with the dates cut short. Then there was complaining.
  2. On March 27, the court finally terminated the Camacho case (without prejudice). Also on March 27, Daniel Defense renewed its motion to dismiss the Torres case.
  3. If they enforce the mag capacity law the way Chicago does, they'll seize your mags if they find them. You'd have to sue them to get them back. Good luck with that.

Long answer: By the Rules of Appellate Procedure, the government has 30 days to file an intent to appeal, which is not an appeal itself. 30 days from March 8 (the date of the decision) is April 7, which is a Sunday, so the real deadline is April 5. The government can also ask for an extension to file notice up to another 30 days. Filing the notice to appeal gives it another 60 days to file the actual appeal, although the government can ask for an extension of that up to 180 days. That may seem like a pretty slow process, but this case has been going since September 2020. Short answer: The government is going to have to file something by April 5 if it intends to do anything. "Something" won't necessarily be the appeal itself. Meanwhile in my inbox today: Um, no. The federal district court didn't say anything about a FOID. It ruled on part of the Gun Control Act of 1968. It might have legal implications on the FOID, but we actually need to go down that road to go down that road.

  7. It leaves it on shakier grounds. If undocumented immigrants cannot be prosecuted for federal weapons charges, it doesn't mean they cannot be prosecuted for state weapons charges. But if any state can prosecute someone for constitutionally protected conduct, it points out that the state law is federally unconstitutional. IMO the more arguments we have against the FOID, the better.
  8. Eva Davis, the previously sole remaining plaintiff under 21, turns 21 next week. On March 22, FPC, SAF, and ISRA asked the court to add Jacob Fournie as a plaintiff. He's currently 19.
  9. Public sale = sold by or through a company to the general public, such as storefront or auction For firearms, "public sale" generally means "sold by an FFL." Private sale = sold by a private individual For firearms, "private sale" generally means "sold by an unlicensed individual." The Gun Control Act does not prohibit private sales across state lines. It does, however, require the facilitation of an FFL who does business in the state of residence of the buyer/recipient/transferee (if the buyer/recipient/transferee is unlicensed) for a private sale.
  10. The ISP is, in some ways, a regulatory body that can interpret the law however it wants, unless JCAR says otherwise. However, ISP doesn't enforce PICA. ASAs enforce PICA. Local PDs will do whatever their ASA tells them to do. If you live somewhere other than Cook, Lake, or Sangamon, you're probably okay, but "probably" is no guarantee.
  11. Carbajal-Flores had his federal firearm possession charge dismissed. Theoretically Illinois could still charge him for not having a FOID, which would be an interesting case. That's the difference.
