Foid card denial question

Since it was not a forcible felony, you should be able to file an appeal with the Illinois State Police.

These appeals are taking anywhere from 6 mos. to a year or more so be prepared for a wait. If you decide to file the appeal, we suggest sending it via special delivery with a request for a signed receipt. Keep a complete set of the appeal documents for your own files.

There is more to do than just the forms. The first link lists additional info and instructions you will need to complete. Also, it's good to have a copy of court documents showing the disposition of the case and that you successfully completed any probation requirements.

 

4. Notarized, signed and dated, statement in your own words, including the following information:
a.Details and circumstances regarding any and all convictions;
b.Statements regarding any sentence including jail time or probation served; and,
c.Statements regarding your compliance or non-compliance with the terms and conditions of your probation or parole, including any required drug testing.
d.Statements to support your suitability for the restoration of your firearm rights.

5.At least three current (within 45 days), notarized letters from adults (signed and dated), at least one from an adult living with you*, stating:
a.His/her full name, date of birth, and relationship to you;
b.His/her opinion of your current risk of dangerousness;
c.His/her opinion of your ability to possess firearms in a manner that will not be dangerous to public safety or yourself; and
d.His/her knowledge of your criminal history and/or denial/revocation of your FOID card.
*If no adult is living with you, a letter from a close relative is acceptable.

Are you eligible for expungement? Even an adjudicated minor with a forcible felony can get that expunged, provided they meet the criteria. It would be better for you in the long run to wipe it from your sheet, if that's possible.

@Bearsfan,

 

Please look into expungement. Your records are already sealed as per state law. It doesn't matter if you were adjudicated a delinquent minor, you were still a minor so it gets sealed. You've kept your nose clean for 18 years. You MUST be eligible for expungement. I'm willing to do a little bit of legwork for you if you'd like. It would really be best for you in the long run to get it removed.

Yes, I have confirmed with ISP that your appeal must be filed in Circuit Court. We can help walk you through that. In the mean time, you need to collect all the information that is listed on those forms. You will need it and the letters to present in your petition for relief to the court.
