  1. That’s what I’m in the process of doing now. I believe it is very wrong that they don’t allow for mistakes on their part that can easily be proven without a long drawn out appeal process. My attorney has sent a request for information as to where they are getting their information from, several weeks ago and have yet to receive a answer. It only took Iowa 2 days get get my information of my records. It seems more like a witch hunt on their part and they don’t care if they’re right. I could understand a mistake, but should be a easy fix, but when it took 10 weeks after a denial just to get a letter as to why it was denied and calling no one knows why you were denied or when you’ll get a letter stating the reason making it drag out longer. I love going hunting but until I get this mistake proven (which I have in my hands) it looks like this year is out not to mention the cost on this mistake. I feel their should be a recourse or someone that you could complain to about these problems that they creating or at lease a timely limit that they must respond.
  2. I was just wanting to know if anyone else has had this happen to them and if so what they did about straightening it out. I’ve done a lot of searching and have not found anything except courts records to be incorrect, but the records seem to be correct. The only thing I can come up with is the ISP read the wrong statute. I’m sorry Molly B. for ranting it’s just I can’t find anything out there on this matter and short of what I’m doing now. Looks like it’s going to be a long drawn out deal and it shouldn’t be that way. I’m in no way trying to lighten what happened 29 years ago. It was stupid, but was never labeled a felony or even charged under that statute.
  3. I’m meant to say the letter said (convicted of a class C felony) not charged. As I stated earlier I have had my foid renewed twice since this happened in 1989 and have had back ground checks done on several purchases I have made. That’s why it makes no sense. At no point at any time has it ever been questioned or brought up.
  4. Yes it came with the appeal papers and no statute. Just said charged with a class C felony. When I got my Iowa criminal report information it gave the statute of IA204.401.3 which states. Section 204.401(3) makes possession of a controlled substance, subject to the enumerated exceptions therein, unlawful. As material here it provides: "* * * Any person who violates this subsection is guilty of a misdemeanor, and upon conviction shall be punished by imprisonment in the county jail for not to exceed one year, or by a fine of not more than one thousand dollars or both such imprisonment and fine. * * *. All or any part of a sentence imposed pursuant to this section may be suspended and the person placed upon probation under such terms and conditions as the court may impose including the active participation by such person in a drug treatment, rehabilitation or educational program approved by the court." At no point was I ever charged with a felony and there was no bond set, no time served or implied, and no probation or stipulation set just the fine. My attorney cost more,($500) than the fine ($300) and that was the last I ever heard of it again until now.
  5. I have had a foid card for around 50 years. I just reapplied and was denied. After 8 weeks I finally get a letter, (after several phone calls) stating I was convicted of a felony (1989) 29 years ago in Iowa. Even though Ive had my foid card reissued 2 times since. It stated I was convicted of a class C felony. To which I have never been charge or convicted of such an offense. Ive hired a attorney (because I have no clue how to prove something from that long ago) and he has got my record which proves that I only had a misdemeanor for possession was fined $300 and that was it. I didnt even have to appear in court. Just pay the fine. I was never charged at any time with a felony and my attorney is trying to find out where theyre getting their information from? Of course they (ISP) have not responded as of yet. They dont seem to care if their facts are correct or not and dont give you a chance to prove them wrong without a very long drawn out appeal. My question is what can I expect to resolve this false accusation and restore my foid card and is there any quicker way to prove the truth?
