Fake suppressor and high capacity mag.

have a very serious question and need helpful advice Fast!!! So On Monday my cousin was stopped by Chicago Police and he was armed with a Master-Arms Mac-10 pistol with the fake Compressor that comes with the thing. Can you guys believe that he was charged NOT WITH THE GUN but given a FELONY for the fake Compressor(Sold with the weapon at the Gun store) and the 30 round magazine(Standard polymer mag that comes with the pistol). What am I missing here?? What Illinois Statute was he in violation of??

First don't give any more details in public and tell your friend to hire an attorney.

 

That said, without more details if the pistols was being legally transported (as I assume it was if he was not given a gun charge as you claim) then he stands a good chance of getting off the other charges with an attorney and fight. The Mac-10 is a pistol and with state prememption on pistols Chicago should not be able to enforce their ordinance on magazine restrictions for pistols, athough I don't know if this has actually been tested in the courts yet and I have to think Chicago is not in a hurry to test the legality of their ordinance so chances are good they won't push hard if your friend pushes back, as for the fake fake suppressor the police are not in a position to determine it real or fake and will amost always error on the side of illegal, and again an attorney should be able to get that charge dropped if it is truly nothing but a fancy barrel extention.

 

It's still going to cost him a small fortune to fight this though and nothing is a guarantee, so Chicago is likley to use the leverage to get a plea deal.

There is no Illinois statute violated. Chicago has a 15 rd mag ban on their books but the state has preemption on handguns. As said not been tested yet afaik...usually an add-on charge.

 

Fake suppressor is fake. That charge should go away. Unless some lobbyists have pull to make them see the light, I expect hes going to be spending some time and money on a lawyer.

I'm guessing this won't go far, once the DA hears of a competent attorney. But, this was kind of a Darwinian move. He walks in with a fake suppressor and he thinks this is a good idea? What about a fake grenade or RPG? At what point should a little common sense kick in??

 

The good news is, once a good attorney empties is wallet, he will get all of the charges dropped as the city has no interest in a court challenge, but what a dumb move.

These Masterpiece Arms MAC-10 pistols come with the Barrel Extention(Fake suppressor). Its nothing he added on. I honestly wouldnt think a Police Officer would ever think it was a Real Silencer. I was wrong.

I think we all agree they should be legal, but they aren't. Bringing a fake suppressor that looks very real to the LEO is dumb, period.

There are several municipalities (in Illinois and elsewhere) that outlaw airsoft guns because they look like real guns. Even if the orange caps are in-place, they're still illegal. Yes, they just outlaw toys. The real issue is whether Chicago outlaws imitation suppressors. I'm not sure they do, but I'm also too lazy to look right now.

I’m going to say this and mean no disrespect to anyone, but if you want to carry what looks like a great gang banger gun to look badder, that’s not what the FCCA was for. Too much work went into this to not use some common sense.

I see no problem w/the fake suppressor on the Mac-10 or any other weapon that comes w/it. I have a slip-on 50cal muzzle break on my 10/22. I laugh at it all the time but it makes my 10/22 look like a baby 50cal. Should I take it off in case LE thinks I have a real 50cal in my trunk. I have posted multiple times on CPD making municipal ordinance arrests on magazines higher than 15rds w/a CCL. Before I got my own FFL, I worked at Shoot Point Blank in Hodgkins, a few customers had said it happened to them and came in specifically looking for firearms w/15rd magazines. What we read as the law, and what LE interprets whether its there call or a General Order, its happening. People here will argue on the lawfulness or the intent but nevertheless LE is arresting gun owners for it. Neither person I spoke to wanted the challenge and I don't either, but if it happens to me, I'm all in; lawyers, appeals, IL Supreme Court, the works.

He has a CCL!! I’m not exactly sure what a “Great Gangbanger Gun” looks like. Maybe the issue you raised should be brought to the attention of the Manufacturers at Masterpiece Arms. A Mac 10 is a “PISTOL”. So no different from those who use AR-15 pistols or AK-47 draco pistols as truck Guns. I wrote that he “WAS STOPPED” in a vehicle that is. Furthermore I think each and every one of us value our CCL in Illinois. Each of us had to take that 16 hr course and spend 300+. I was genuinely looking for some assistance with Legal advice here not any personal firearm preference critiques.

Why are some of you under the impression that he was BRINGING the weapon anywhere??? The FAKE SUPPRESSOR is nothing more than a barrel extension. He was stopped in his vehicle with this

 

If he has an FCCL, concealed on his person or in the vehicle is 100% legal. It is a pistol covered under the FCCA not Chicago or Crook County ordinance.

I see no problem w/the fake suppressor on the Mac-10 or any other weapon that comes w/it.

 

A lot of people put them on to control recoil and muzzle climb,especially on the MAC10s.

 

 

Notice how when someone says something that someone doesn't like they get all ugly?

 

Ever notice when the gun the another guy chooses to carry, purchase, own or transport doesn't fit someone elses choice some choose to resort to belittling and passive attacking instead of help and support for the lawful activity and exercise of the 2nd?
