Oak Park Firearm Regulation Forum - Public Safety Issue

Here is the breakdown of the department of public health (DPH) meeting tonight. The meeting on the website is scheduled from 6p to 9p. The room it was scheduled to be in was only big enough for about 15 to 20 people plus the DPH members. Needless to say it was packed. Meeting is starts on time more or less.

 

DPH limits speakers to 4 as "we only have till 7 pm and have other issues to address". All 4 speakers are against new regulations. 1 special advisor who was a prior member of the board of health who sat on the 1984 regs whom I don't remember a name and Mike Walsh from ICAGV are the only guests. Mr. Walsh recommends registry, permits, yearly qualification for all gun owners, manditory storage, special licencing of gun shops, manditory reporting of loss or stolen firearms. A couple of citizens ask for clarification to Mr. Walsh's remarks. DPH makes it clear that they will not entertain any comments from the floor. A lot of good questions from the DPH but it becomes obvious that the board is not much more informed about the issue than your average non gun owning citizen. The special guest from the previous ban was suprisingly knowledgeable and asked some pretty critical questions of Mr. Walsh. The conversaton centers mainly around the registry and licensing of gun shops. A small discussion about manditory storage. DPH says it is going to move on to the next issue, bike safety.

 

This clears the room including Mr. Walsh, but not the other special guest. DPH then procedes to discuss the firearm issue for another 10 to 15 minutes mainly discussing licensing of gun stores, comments about trying to zone all gun stores out of Oak Park from one DPH member and manditory registration before moving on to bike safety. Bla, bla helmet law. The chair will be out of town for the next meeting in March so one of the other members will have to chair. Some discussion about how the trustees dumped this issue on DPH and how it is holding up other issues that actually relate to public health and then a bit of discussion about communications of DPH members between meetings and the illinois open meetings act and concequenses for violating the act.

The four who spoke at the beginning of the meeting were each given 3 minutes and made the most of their time. All spoke from prepared texts (or so it seemed) and were very articulate. All the issues that have been discussed here were covered by the speakers including the lawsuits that Oak Park has lost, the fact that the citizens are having to pick up the bill when Oak Park looses, the Second Amendment rights aspect, the fact that public opinion is now strongly in favor of people having the freedom to exercise their Second Amendment rights. The point was made a couple of times that the meeting agenda was biased due to no presence of a pro-2A viewpoint, yet the guest of honor was the anti-rights Walsh guy from Gun Ban Inc or whatever his group is called. The chair and other members of the board tried to cut off each attempt by non-board members to comment or question. Mike W got his question in and it really put the anti-rights Walsh guy in an awkward position. The question was "What are your qualifications in health care?" (or something like that). Walsh swung around in his chair, glared at Mike and narrowed his beady little eyes and admitted he was not a health care expert, but gave his job title, wup-tee-doo. That Walsh has a weird demeanor, a very flat affect, and crazy eyes. Most members of the board seemed to think Walsh was the Oracle of Delphi and seemed positively disposed toward his laundry list of gun control. One member of the board, a physician wanted scientific, quantitative data about the efficacy of the gun control laws Walsh was peddling, and Walsh admitted he didn't have that data, although the laws have helped in other jurisdictions he claimed.

 

One guy from our viewpoint skillfully obtained a commitment from the board that he would be allowed time and a role at the NEXT health meeting similar to the role that Walsh was given this evening. He even obtained the commitment from the board that they would put that it in writing. I was impressed by how well he handled the board, as they were obviously hostile to his position and viewpoint.

 

Not one member of the general public spoke in favor of gun control in Oak Park.

 

I put some color prints of the $399,950 check that Chicago wrote to the Second Amendment Foundation on the table where the board was seated, and was able to escape before the discussion of bicycle safety.

 

A reporter was in the meeting, recorded everything and took constant notes, so probably will appear in the news media tomorrow.

Talked briefly to the special advisor on his way out He mentioned he had already served 2 terms on the board. (I'm getting the feeling theres some term limit for the board on his comments) Oh Btw he said he's a gun owner too Shhhh!

 

 

Menard was more docile than I was expecting.

 

I also came in thru the chicago side to the meeting and got a little off the normal path. I was surprised at how many flashing blue light cameras I saw and there was an extra bonus of an undercover cpd squad frisking a youth against a fence at a intersection.

Thoughts on guns and middle ground

Dan Haley's Feb. 15 column [Finding the middle on guns, News] stimulated my thinking about Oak Park and the middle ground for gun control.

 

1) Why are restrictions on legally-owned guns expected to solve the problem of unrestricted illegal guns? Until this issue is resolved, no middle ground can be reached.

 

2) "The Second Amendment is in political ascendancy." Citizens have the right to defend themselves — this is the intent of the founding fathers, the intent of the living constitution and a right guaranteed by the Second Amendment. As long as the right to self-defense is viewed as merely an obstruction by the gun-control crowd, there will be no middle ground.

 

3) Katrina pushed registration of legally-owned guns by local authorities off the table for the time being — the confiscation of legally-owned guns by the New Orleans police in the aftermath of Katrina (later ruled unconstitutional) destroyed any trust in local authorities by the opponents of stricter gun control.

 

4) I was not aware the 1984 ban was mainly symbolic. If this is true, then why did Oak Park waste $ in an appeal to maintain a law that was clearly unconstitutional as written?

A gun control expert offered several ideas for regulating firearms Tuesday as part of Oak Park’s effort to develop a new law after the village’s long-time ban on handguns was struck down by the Supreme Court.

 

Requiring all gun owners to register with the village was one of the ideas floated by Mark Walsh, campaign director for the Illinois Council Against Handgun Violence.

 

Walsh was asked to speak to Oak Park’s Board of Health and recommend possible changes to law regarding how to keep residents safe, how to minimize violence and how to protect police and fire employees, Chairwoman Kamana Mbekeani said. The meeting is part of the village’s process to consider options after a July 2010 a U.S. Supreme Court decision invalidated a local handgun ban enacted in Oak Park in April 1984.

 

Oak Park resident Joel Lowrie and others asked the board why a more moderate speaker was not brought in to present.

 

“I would hope (Walsh’s) presentation is factual and verifiable, not focused on isolated incidents,” resident Harold Stoetzner said. “Criminals will always get weapons; they follow no laws but their own.”

 

Walsh suggested Oak Park look into requiring a local registration of firearms, requiring a report of lost or stolen firearms within 72 hours of discovery and requiring regular training and range qualification for gun owners.

 

Ravi Grivois-Shah and other members of the board of health said they want to see evidence that gun registries decrease violence before moving forward.

 

“We need to understand what evidence is behind our recommendation,” Grivois-Shah said. “The recommendation to the board should be based on evidence … there’s very little I’m getting in terms of good evidence.”

 

Walsh said requiring licensing for village gun dealers gives control to local authorities for inspections and safety measures. The village also could require cameras or alarm systems to deter break-ins to gun shops, he said.

 

“Inspections would be similar to restaurants – as a public safety issue,” Walsh said.

 

Mbekeani asked volunteers from the board to form a subcommittee to gather more research and look for studies on handgun regulations. Mbekeani said the board of health plans to bring a recommendation to the board of trustees in June.

 

Resident Dirk Hoeir urged the board to focus on not losing any more taxpayer money in legal battles related to gun issues.

 

The next board of health meeting is scheduled for March 27.

One guy from our viewpoint skillfully obtained a commitment from the board that he would be allowed time and a role at the NEXT health meeting similar to the role that Walsh was given this evening. He even obtained the commitment from the board that they would put that it in writing. I was impressed by how well he handled the board, as they were obviously hostile to his position and viewpoint.

That was David Schweig and I think that was the reason behind limiting it to four speakers, I believe that his witness sheet was next in the stack. ie They kept him from speaking.

 

He very effectivly rubbed everyone's nose it at the last meeting, including Village President Pope and Village Manager Barwin.

A few question come to mind:

 

If Oak Park required yearly qualifications would they allow a range to be built in town to accommodate the requirement? Nope didn't think so.

 

If registration is such a great idea why did Canada just dump theirs as a colossal failure?

Can't prohibit the range but it's illegal to discharge a firearm, starter pistol, BB gun, bow and arrow or cap gun in the village. I'd get one of those rubber band guns from Branson, MO and shoot it at the range but I'm pretty sure they would ban that too.

 

 

If Oak Park required yearly qualifications would they allow a range to be built in town to accommodate the requirement? Nope didn't think so.

 

According to Ezell v. Chicago, they can't prohibit a range being built inside the city.

As Oak Park continues to explore how it wants to regulate handguns in the village, if at all, one expert had a few suggestions last week.

 

Ever since the Supreme Court struck down Oak Park's longtime handgun ban in 2010, the Oak Park Board of Health has been exploring ways to govern gun use going forward. They held a well-attended public forum in January, and on Feb. 28, a handgun-control expert made a couple of suggestions.

 

Mark Walsh, campaign director for the Illinois Council Against Handgun Violence, suggested four solutions during a health board meeting last week. Those included requiring gun dealers to get a local license, starting a registry for handgun owners, implementing measures to safely store guns in homes, and mandating that gun owners report their firearms lost or stolen with 72 hours.

 

But some, such as lifelong National Rifle Association member and Oak Parker Dirk Hoerr, think those suggestions are an unnecessary nuisance to gun owners. Oak Park is still battling the NRA in court over paying its attorney fees, and Hoerr said the village should be careful not to invite another legal battle. Instead, education should be the focus, he said.

 

"My concern is that there's a bill coming due for losing that lawsuit, and I don't think that they need to be challenging what the Supreme Court of the United States has already deemed a constitutional right, inviting more lawsuits," he said by phone this week. "In these tough economic times, it's just an area of exposure that's unnecessary."

 

Walsh disagreed, saying that some of the measures have already been implemented in other communities and would have no problem standing up in court.

 

"Obviously there are concerns among folks in Oak Park about not knowing the amount the village has to pay from the previous suit, but these have all withstood court scrutiny and other challenges," Walsh said in a phone interview.

 

Members of the board of health now plan to delve deeper into Walsh's suggestions by looking for data to back them up, according to Margaret Provost-Fyfe, director of the Oak Park Health Department. A couple of health board members will do some research before reporting back to the full board sometime this summer.

 

They eventually hope to make a recommendation to the Oak Park village board.

What should the Village Board consider in order to keep Oak Park safe in light of the McDonald decision? How can we as a community minimize firearms accidents? What can we, as a community, do to minimize firearms thefts and the consequences of those thefts? What can we do to insure that innocent people are not injured by firearms by someone who does not understand the inherent dangers of firearms and the potential consequences of their actions? Are there measures we should take to protect our police and fire employees as they serve our employees? States that there are monumental costs associated with increased firearms including medical response, rehabilitation, court costs, incarceration. Firearm safety is an important public health, fiscal and public policy issue. This forum is not a debate of 2nd amendment rights. Whatever recommendations the Board of Health makes will need to be reviewed for compliance with laws and court cases that apply.

Dr. Mbekeani provided comments on the primary mission and role of the Board of Health.

Dan Dittmer, 135 South Harvey Avenue, Oak Park: ‘Responsible, capable, adults citizens – some of them armed – are at the heart of public safety. Local government that works is the result of their efforts…’

Robert Saffle, 911 South Wesley Avenue, Oak Park: Thinks trigger locks and safes are a good idea; FOID card already makes a background check; registering a handgun would be a moot point; any additional assault weapons ban would be redundant.

Joel Lowrie, 1128 South Oak Park Avenue, Oak Park: Regarding evaluating ‘existing Oak Park ordinance’, reminding that non-criminal citizens have very strong rights when it comes to possession of individual firearms for protection. Oak Park faces additional liability if it restricts firearms ownership or possession. No city government has the ability to protect every individual. Imagines that motor vehicle accidents are at a greater cost and greater in number. Look at reckless endangerment law in Illinois: already a law on Oak Park books. Disagrees with storage option that are available - certain communities require that firearms need to be stored in a safe or that you may need a trigger lock or that ammunition be stored in a separate secure place from the firearm.

g.

Jim Kelly, 1043 South Harvey Avenue, Oak Park: Lives in the neighborhood where the first license to sell firearms is located. Advocates for a zoning ordinance in Oak Park; that we go ‘right up to that line’ so that it is still possible to open a (firearms) business but it is kept away from schools, parks, pre-schools, playgrounds and that a codified set of safety measurements be in place in those businesses before they can open. Essential to codify what measurements are required for a firearms business and codify the safest area possible where (a firearms business) can open.

h.

Edward C. Ferraro, 1209 Linden Avenue, Oak Park: Bothered that gun control is being brought up as part of the Health Board. States that Centers for Disease Control (CDC) website (indicates) that majority of deaths are not from firearms. Not gun violence, but gang violence – that is where efforts should be put, trying to control gangs. State that of the leading causes of death, ‘accidents’, is number five. Health efforts should be more directed to health issues and not gun issues.

i.

Sandra Shimon, 304 North Grove, Oak Park: States that the presence of a gun in the home is a danger to the population. Advocate for the most

restrictive, constitutional legislation possible in Oak Park.

j. Chip Buerger, 1106 Columbian Avenue, Oak Park: Illinois residents are

already required to have a FOID card. The handgun ban did not stop

criminals from violence. This is a law and order issue. Can’t pass laws or

codes that criminals will obey. Will there be lawsuits? What will be the total cost of passing any new regulation? The Village is not in a financial situation to really afford lawsuits at this time or in the near future. Let’s target the gangs.

k.

Edward Downs, 1125 Wisconsin Avenue, Oak Park: No place to record when a handgun was pulled and a criminal ran away. States that the number of children hurt by handguns is dropping regularly and that gun ‘accidents’ are suicides, but recorded as accidents. Don’t think we need to have a handgun ban or any other ban with honest citizens.

Dave Schweig, 411 North Humphrey Avenue, Oak Park: States that somewhere between 2.5 and 3 million instances of violence are prevented due to the presence of handguns and that the existence of handguns stops crime. States that handgun ban has not done anything. How much does Oak Park owe for legal fees? Is it funded? Forty-nine states have conceal/carry laws.

m.

Doug Hills, 1009 South Humphrey Avenue, Oak Park: States that regulation in this community puts us in a very difficult place, legally. States that there were fourteen burglaries in his neighborhood in the

past two months. State of Illinois has some of the most strict gun laws in the country. If conceal /carry passes, it would require gun owners to take a class. Board should address how we protect our freedoms to protect ourselves in our own homes.

n.

David H. Gawne, 625 North Cuyler Avenue, Oak Park: States that all states, except Illinois, have grossly limited their restrictions on guns. Guns are tools – a person is responsible when someone gets shot, not a gun. ‘Moving in the right direction’ however. Recommends an extended committee with 5 - 6 people on each side to continue to discuss this and make final recommendations.

Gary Barnes, 627 South Humphrey, Oak Park: We who have depended upon the gun ban for our safety will have to change the Supreme Court.

We have to make this a society where people want to live here and are not threatened. We should have a regulation that protects our Police Officers from any casual relationship with the gun shop.

p.

Kyle Davis, 945 Fair Oak Avenue, Oak Park: Don’t know that any type of

registration that will protect Police. Don’t infringe on my rights as a

sportsman, gun owner. Education, safety rather than regulation, bans.

Proximity to schools is not going to make anyone any safer.

q.

Michael Podolak, 1176 South Ridgeland Avenue, Oak Park: Guns were

invented as a quicker, more reliable way to kill another human being.

States that there are about 75,000 deaths from handguns every year and that about 1/3 of gun accidents could be prevented. Better education in schools could prevent many more deaths. Feels strongly about people being educated as a requirement.

Alice Norris, 1025 Pleasant Place, Oak Park: Should be regulations for

guns. Has a 45 year old daughter grazed by a gun at 4 years old.

Brother, cab driver, shot, costing total of$85,000 for medical care. In

1993, 14 year old girl, her daughter, was shot in a drive-by shooting; one bullet to the head killed her; hospital bill was $58,000. Taxpayers must pay the bill. Does not want a gun in her home.

Reshnia Desai, 1151 South Lyman Avenue: States that when guns are used in a domestic violence situation, victims are twelve times more likely to die than in situations without guns; when a gun is in the home, it is four times more likely to be involved in an unintentional shooting, seven times more likely to be used to commit a criminal assault or homicide and eleven times more likely to be used in an attempt or commit suicide than to be used in self defense. States that guns in the home increase the risk of homicide by three times and the risk of suicide by five times. States that in 48% of homes with children, guns are not equipped with child safety locks; 56% percent of students in grade 6-12 know where to get a gun and 2/3 know how to get a gun within 24 hours. Educate citizens about dangers of guns in the home; Village, police and county judicial systems need to be educated about federal and state laws to have guns removed if someone is in fear of their life; educate of children in every age range. Work with mental health professionals in collaboration with the Police Department. If homeowners own guns, they should be stored safely; Village should monitor if guns are being stored safely. Fine residents that are not following the laws.

George Sanders, 1136 South Euclid, Oak Park : State that the American Academy of Sciences found that, overall, guns used by criminals are purchased from illegitimate sources. Criminals are afraid of an armed homeowner. States that gun accidents are the lowest cause of death among children; swimming pools and caustic materials cause more deaths among children. State that if a women defends herself against an attacker, she is more likely to be injured seriously if she is unarmed, than if she is armed. States that the higher the gun ownership in America, the lower the crime rate.

Village to take up the zoning issue in relation to firearm sales and

ownership rules.

Mike Weisman, Virginia Avenue, Unincorporated Du Page County:

No public health issue in Oak Park from law-abiding gun owners. Health care cost is from criminal element. States there has been no increase in crime since the McDonald decision.

There's about to be some bad blood between CPD and OPPD

A debate has been brewing on OakPark.com over the past few weeks on whether Chicago police should be allowed to park illegally around the village. Reader Brent Showalter snapped a couple of pics of police cars parked in tow zones in downtown Oak Park, with nary a ticket to be found. Well, just recently, an anonymous tipster spotted this Chicago police vehicle, parked illegally across the street from Lallo's, with one of those dreaded little orange envelopes on its windshield. Maybe all the angry web comments got someone's attention.

I'd be willing to bet that the parking enforcement folks slipped an empty envelope on the windshield. That kind of thing is just not done out of professional courtesy. The firearm issue may or may not be on the agenda this month due to the nursing home killing that occurred recently. I'm trying to get clarification from the village

It is interesting to note that less than a month before the Jan. 24th Board of Health Meeting, there were two new board members appointed.

Board of Health - Ravi Grivios-Shah, Appoint as Member, Florence Miller, Appoint as Member at the Regular Board Meeting on January 3rd.

 

A cynical person might ask the question if there was a litimus test on this issue that these two new members were put through.

 

A FOIA request could be filed to request information on this as well as to be certain that the Open Meetings Act was not violated. Since Oak Park has been found in violation of the open meetings act in the past, I would be curious to know if that was the case with this or if there was improper meeting with LCAV/Illinois Council Against Handgun Violence.

I'm not sure what to make of Ravi Grivois-Shah, he sounds like he might be on our side. Anyway, I found this...

It's disgusting the amount of nanny-statism the residents of places like that tolerate.

 

 

Having said that, I truly appreciate the effort being made by a few folks there to exact some positive change! These are the battlefields on which our country's fate rests.:rolleyes:

I can quote the Dr. Grivois-Shah as saying, "I would ban all guns if I had the ability." as an aside at the February meeting. He seems like he is data driven and willing to put aside personal beliefs if the data doesn't support them.

 

 

Ravi Grivois-Shah and other members of the board of health said they want to see evidence that gun registries decrease violence before moving forward.

 

"We need to understand what evidence is behind our recommendation," Grivois-Shah said. "The recommendation to the board should be based on evidence … there's very little I'm getting in terms of good evidence."

 

 

Any bets on whether or not he gets the evidence he requested by the next meeting?
