CCW Under Board Review

I completed my CCW class, and applied for my my license 02/23/2020. It has been "Under Review" until recently as 06/19/2020, it was "Under Board Review". From reading in the forum, under board review doesn't sound good. My FOID is active, and been active for almost 10 years. I was arrested back in 2014 but charges were dropped and record expunged. I have documentation to prove expungement. Any ideas as to what's going on?

The arresting agency has posed an objection to you having a CCL. Unfortunately It’s going to be over a year before the board gets to your specific case. Keep copies of your Expungement order!! Once you present that to the board you’ll almost certainly have the objection overruled and be issued the permit!!! Sorry to be the bearer of the news but..... Keep your nose clean and good luck.

Are you sure they were expunged? Did you have a search done afterwards or just have a paper from someone telling you they expunged them? I dont know who can view expunged records.

 

The board is still 2 members short and it isnt clear how often they are meeting nor the impact of being short of members is having.

The bad news is that the CCL Review Board is way behind in reviewing objections. There are vacancies on the board that the Gov. has not filled yet and that has slowed the rate at which they are reviewing cases. Some have been waiting for 5 months or so from what I am hearing.

 

The good news is that the Board is overruling about 80-85% of the objections. Nothing you can do at this point but wait.

Keep an eye on your FOID. Different background checks come up different things. Sometimes something is discovered on the CCL that got missed on FOID. Not saying its common but has happened before. There are some stories of that on this site.

 

Are you in cook? If you ever had an interaction with law enforcement dart would reject it.

Even if you never had interaction with law enforcement you can get Darted. I went under board review and was denied back in 2014. Seems there are multiple people with my name and they never bothered to verify whether I was the person that law enforcement objected to. You would think that they would at least be able to verify the persons identity, but I guess that was asking too much. So there are cases of mistaken identity that happen as well. Anything is possible when it comes to the games they play in Cook County.

Yes I am in cook county. Haven't had any interaction with law enforcement since my arrest back in 2014. But IF its expunged how would cook county see it if it "shouldn't exist"? Unless I am not understanding the expungement in its entirety.

From my understanding, so i could be wrong so take it for what its worth. If you get it expunged, they are supposed to send it out to other agency's to erase. Not all may have been notified. I.E. Courts give you back all files, they forget to notify leads to erase the incident in their system. Again i could be wrong.

 

Or just cook county is keeping a secret set of books. Which is always a possibility.

One would think that just having a FOID card would get you past the initial CCL process, but that not the case.

You could and more than likely have owned firearms for many years. But you haven’t been able to legally carry concealed during all that time. Many can own, and many cont carry outside their own property etc.

 

Haven’t had any interaction with law enforcement since my arrest in 2014. Then the answer above that would be yes to the have you had any interaction with law enforcement.

 

Have you received a letter telling you why you are under board review? If not then you are spinning your wheels on checking all these background and such, spending your own funds.

 

If you troll the threads here you and several hundred others are in the same boat and all want to sue the state. My suggestion is to bond together and file suit. Maybe with the amount of people and the combining the tons of cash you'll need it may get done.

But no one here has shied before and yet everyone who has a card always says to just sue the state.

 

The STATE of Affairs here in Illinois is totally against the carry of any firearm ever made to known mankind!

And no additional threads telling others how unjust this STATE is will change it. Since I have been a member it’s been post after post about the flaws in the wording of the statute, the slow processes, the rights being denied. And in the end it all comes down to dumb luck if they get to it or if they don’t. We are at the mercy of the all knowing Democrats.

 

I wish you all the best of luck, but all the stress you and others are going through really isn’t worth it.

Just got a letter today dated from the 6/25. Pretty much just states that they received an objection from an agency. They'll issue a decision within 30 days of the objection unless they need an additional 30 days. Nothing in this letter stating who or what the objections are. I'm just going to relax at this point. It's really starting not to be worth it at this point with Cook County.

Similar with me. There is a guy with the same name (first, middle and last) as me, same date of birth, same year of birth, lives two counties away, and he has a felony domestic abuse conviction. This has caused me problems in the past. It may have been straitened out though. It did not affect my CCL app three years ago, and my most recent 3 firearms purchases were not delayed. Prior to those three, I had some problems on occasion.

I been waiting since 2017 for my picense back smh. They keep finding one thing after the other. Soon as i fix one issue they tell me about a new issue lol. Smh. Now they told me i have a warrant from 2009 from another state lol. When i had that warrant for years and they gave me my license in 2015. Now its a issue. But i took care of the warrant and emailed them like they said and got no response still since june 22 this yr smh. I guess they are mad i got the warrant fixed mpw they are just making me wait just to make me wait. This is the games they play here.

I always thought they had 30 days to object to someone's CCL.Yes, they do have a 30 day objection window, but in the current environment, Im not real sure when that period starts, doubting it is from date submitted. And dont expect a 30 day decision on the objection.

The 30 day window for LE objections starts when the application is submitted. After that, the opportunity for LE to object goes away.

I know mine sat in submitted for the longest time.

The FCCL act says the objection period is for 30 days after submitted application entry into database. It also says that they have 10 days to enter into database after submission which doesnt seem to happen much anymore.

 

Ive wondered if there were JCAR admin rules that changed this or is it just they decided on their own they want to do BG checks first to see if a denial before turning over to LE as I believe Molly has posted before?

The 30 day window begins once the background checks are completed and the application is entered into the database available to law enforcement agencies. This could be 30 days after submitting or, sadly, it could be 119 days after submitting . . .
Molly, if I understand your response correctly, I think they gave you some bad information.

 

A portion of my job at my LE agency is doing local background checks on CCL applicants. I've been doing this since the FCCL went into effect in 2013.

 

I can see when the applications are submitted, and law enforcement gets the information as soon as its submitted by the applicant. What I don't know is at what point they do the background checks. Perhaps its during the 30 day window, or after.
