Before she was elected Senator, Gillibrand was at least moderately pro-gun. But it seems that was too much for Bloomberg, Schumer, Schneiderman, etc. Not only does she now vote the wrong way ... she's actually out carrying their water. Very disappointing.
So in New York, private sales at gun shows are illegal. Through a sting, the AG demonstrated that law was sometimes being violated, so instead of toughening NY's already tough law, he's just taking it national. I suspect Bloomberg is behind this (Bloomie did similar gun stings a few years ago, and was criticized for it).
So out of one side of their NY mouths come calls of an over-reaching fed gov (with respect to HR822) and out of the other side come calls for more gov over-reach with regard to the national "private sales ban" bill. Despicable.

NEW YORK — U.S. Sen. Kirsten Gillibrand announced Sunday that she's backing a bill that aims to crack down on corrupt gun dealers as well as eliminate the flow of illegal guns into New York.
Almost 90 percent of the firearms used in New York City gun crimes come from out of state, and most of those guns are illegal, according to the Democratic senator, who plans to introduce the Gun Trafficking Prevention Act this week.
It comes on the heels of an undercover probe into gun shows by New York State Attorney General Eric Schneiderman. Investigators found an open marketplace for illegal weapons, with sellers disregarding mandatory background checks.
The probe also revealed a loophole in the law that holds the individual gun seller legally accountable but not the gun show operator. The legislation would close the nation's "gun show loophole" and keep operators responsible.
"The Attorney General's critical investigation shows just how easy it is for guns to end up in the hands of dangerous people," Gillibrand said in a statement. "By cracking down on gun dealers who blatantly disobey the law as well as illegal gun traffickers and their vast criminal networks, we can reduce gun violence and keep our families and neighborhoods safe."
The undercover operation led to criminal charges against 10 New York gun dealers.
Schneiderman said the probe "confirmed what too many already know: In America, guns are freely available to all, regardless of criminal history or other prohibitive factors."
The new bill toughens penalties, making such sales a crime and suspending a dealer's license.
Traffickers could face up to 20 years in prison. Kingpins who organize gun trafficking rings would be subject to an additional sentence of potentially five consecutive years in prison. And penalties could increase depending on the number of guns trafficked.
In addition, individuals engaged in a conspiracy to traffic guns would be punished equally to those who actually traffic a gun.
Corrupt dealers would be subject to a license suspension of up to six months and a fine of up to $2,500 per violation.

Well, there is no federal law mandating BG checks on intrastate private sales (whether they are at gun shows or elsewhere). Dealers must do BG checks wherever they are. This is part of the confusion ... these articles referring to private sellers as a "dealer."
And yes, of course a fed law regulating private sales at gun shows would supercede state law. That's why they try to pass them!

According the Bureau of Justice, from 1991 through 2003 there were approximately 8,896,460 reported incidents of violent crime nationally. Of those crimes, 5,863,750 (66%) were committed without the use of any type of weapon other than organic. Another 2,304,340 (26%) were committed with a weapon other than a firearm such as a knife, bat, or club. Only 846,950 (10%) of all violent crimes over a 14 year period involved the use of a firearm. Of those 846,950 violent crimes committed, 737,370 (80%) involved handguns, 100,470 (1%) involved either shotguns or rifles, and 9,110 involved an undetermined firearm type (National Crime Victimization, 1991-2003 Survey). This being said, it is more likely that the victim would be killed from a firearm as 70% of all homicides are firearm related. However, it is more likely that the victim would be seriously injured by a knife (24%) or a bat/club (20%) than a firearm (13%) (National Crime Victimization Survey, 1991-2003 Survey).
According to the Federal Bureau of Justice, most adult felons obtained firearms through burglaries (9%), through a drug dealer or fence (29%), additionally, 10% reported stealing at least one firearm and 11% reported selling or trading stolen guns. For Juvenile offenders, more than 50% had stolen at least one firearm during their lifetime and 24% had stolen their most recently obtained handgun (Bureau of Justice Statistics Select Findings: Guns Used in Crimes). This information led the Bureau of Justice to conclude that theft and burglary was the original, not always the proximate, source of many guns acquired by the juveniles (Bureau of Justice Statistics Select Findings: Guns Used in Crimes). It is likely that the actually numbers of felons involved with the previously listed methods of obtaining a firearm is substantial higher as most felons would be reluctant to admit crimes to a governmental body that can recommend charges against them or use their statements as evidence against them.
