Zutbus5 Posted February 2, 2018 at 01:53 AM Share Posted February 2, 2018 at 01:53 AM Hello!I am new to the site. I am retired law enforcement officer of 28 years. I have no criminal background however my FOID card was revoked after self admittance for a 24 hour stay in a mental health facility. I have recently received a conditional job offer that requires a background check. A gun is not required for the job but my concern is that they may find my revoked status and that will prevent me from getting the full offer. They stated a background check would be done by fingerprints through local police agency. So in a nutshell. Do you know if a revoked Foid card is revealed in a background check? mic6010 Posted February 2, 2018 at 07:28 AM Share Posted February 2, 2018 at 07:28 AM I have no idea. But for some reason I doubt that's gonna come up under your criminal background. Its not a crime to have your FOID card revoked in that manner.Being forced into having to get an FOID card to exercise a constitutionally enshrined right is the only crime being committed. gangrel Posted February 2, 2018 at 02:55 PM Share Posted February 2, 2018 at 02:55 PM The FOID revocation on and of itself is not a crime, and the reason for the revocation should be protected from disclosure under HIPAA. Zutbus5 Posted February 3, 2018 at 10:43 PM Author Share Posted February 3, 2018 at 10:43 PM Is there a code that background agencies use that specify revocation reasoning? Once again, this is not a job that requires a gun. I am in the process of getting my card reinstated but by reading on this site it looks like that is a long process. Molly B. Posted February 4, 2018 at 11:51 PM Share Posted February 4, 2018 at 11:51 PM I don't know of any background check done by employers that would show a revoked FOID card - that is protected information - even from FOIA requests. I believe only arrest and conviction records would be made available. The one exception is if the employer is a law enforcement agency - they have access to FOID info. Zutbus5 Posted February 7, 2018 at 04:17 AM Author Share Posted February 7, 2018 at 04:17 AM Update: Thanks for your responses Today I went for fingerprint and physical. I did have to sign an authorization waiver for the background check. The authorization is quite detailed stating that it works in conjunction with the FBI database. It also stated credit, school and medical records. I'm not sure if the criminal all comes back clear, which it will, if they'll dig deeper. I'm having a real dilemma with my brief time of depression because of my huge life changing event. I'm hoping it doesn't prevent me from this job. I had a successful law enforcement career with no issues. My current job has been without issue as well. I'm in the process of trying to get my FOID card reinstated as well. I'd be worried more about your medical records showing the 24 hour stay than the foid revocation.
Zutbus5 Posted February 7, 2018 at 04:28 PM Author Share Posted February 7, 2018 at 04:28 PM Yes, that is my main concern. It was for 24 hours, I am wondering if details are given about that stay. How much information is actually disclosed regarding the mental health records. No work was missed during the stay. The stay was not for a long term issue mostly for extended insomnia due to life change.
