Molly B. Posted September 21, 2015 at 06:33 PM Share Posted September 21, 2015 at 06:33 PM This is another case about denying FOID cards under the Lautenberg Act, misdemeanor domestic violence convictions. The problem here in IL is with the ISP reviewing old cases which were simple battery convictions, cases much older than this one, and reclassifying them as domestic if they involved a family member or someone living in the home. People who have had FOID cards 45-50 years are getting notices that their FOID card has been revoked. In this case, the question of constitutionality was not raised. There are other cases where the question is raised. We hope in those cases, the plaintiff will prevail. http://www.illinoiscourts.gov/Opinions/AppellateCourt/2015/4thDistrict/4141055.pdf
Hap Posted September 21, 2015 at 06:37 PM Share Posted September 21, 2015 at 06:37 PM Is this the result of a systematic review of the entire FOID database looking for this sort of thing, or do these cases just come up as FOIDs expire and renewals are evaluated using a different set of criteria than at earlier renewals?
