FOID Revoked due to Mistaken Identity, Me Also

Recommended Posts

I had my FOID revoked because of mistaken identity also, similar to previous 2016 post by Mistergadgett BTW, my name is not actually JohnDoe, but is an extremely common first and last name.

I received the original revocation letter in 2014 , but chose to ignore it because I knew that it was mistaken identity with another JohnDoe that lived in Decatur. Prior to the ISP letter, Peoria PD had pulled me over because of confusion with the same JohnDoe from Decatur. I was handcuffed and put in the back seat for about 45 minutes until they straightened it out with Decatur PD. Decatur PD had a warrant for violent assault. Peoria officers realized that there was a problem since I am white(other JohnDoe is black) and I have NO tattoos(other JohnDoe has all kinds of tattoos). Both Peoria PD officers said that they had always wondered if they would see a mistaken identity case like this. They told me that the Illinois criminal database system uses Date of Birth and First Name/Middle Initial/Last Name only. Using that, it attached to my Illinois license plate and my Illinois Drivers License. As a computer person, it is obvious that the Identity Key( of DOB and First/Middle Initial/Last Name); used is NOT unique enough for the real world. It needs to be expanded because of my mistaken identity issue.

Decatur John Doe' was admitted to a state facility for chronically mentally ill, and that was the reason for the FOID revocation. Big problem is that 1) We have the exact same Date of Birth..... 2) We are both John L Doe, but our middle names are completely different.

My FOID expires this year, but the COVID issue has caused the State of Illinois to allow extra time for FOID renewals. I recently reapplied and my FOID was still revoked. I had not chosen to challenge the previous revocation because I did not want to give up my FOID for a mistake made by Illinois law enforcement. Plus, I knew that revoked FOID cards are not a big priority for local police. I also read all the information on the ISP website back then, and did not see anything there that addressed my mistaken identity issue.

I did not know about Illinoiscarry.com nor did I know about Mistergadgett's post. I chose to engage an attorney for this. So far, it has taken about 1 week to file various forms with ISP. The attorney is also working on verifying the facts on Decatur JohnDoe's criminal history. I also knew that waiting for 6 years to fix this might expose me to potential legal charges. I also did not want to give up my guns in the current 2020 environment. Guns have been transferred to a neighbor, and ISP form submitted to local PD. Other forms filled out as well.

I will repost with updates on this. I just wanted IllinoisCarry.com people to know that Mistaken Identity happens with Illinois FOIDs.

It does happen. My wife's name is Debra Jean, my brother's wife is a Debra Jean and my cousin with the same last name's wife is Debra Jean. My wife took to hyphenating her maiden and middle name to differentiate between her and the others, but that brings with it another set of problems, drivers licenses, passports and assorted legal documents.

It could be worse. Your story reminds me of a guy with an identical twin brother who kept trying to pass himself as the other brother. DUI's, tickets, arrest warrants, credit cards, trying to take out loans, etc. The normal brother would get stopped and detained on a regularly while driving. Felony stops with guns drawn. Luckily the bad twin had tats and the normal guy didn't. Late for work on a regular basis because of his dirt bag brother. They'd let him go after the towns he drove through on his way to and from work realized what was going on. This was 30 some years ago and I wonder if their system had been improved to avoid similar situations but I guess not.
