xleonex Posted January 8, 2018 at 08:34 PM Share Posted January 8, 2018 at 08:34 PM I'm curious how long does the appeal process take to get back my foid ccl? It's been since July 17'. I got arrested when a previous employer falsely accused me of theft, which was thrown out and I'm currently exspunging the arrest. This is such a draw out process. I called multiple times and vm left and no-one can answer the time it takes.
Craigcelia Posted January 8, 2018 at 08:44 PM Share Posted January 8, 2018 at 08:44 PM Unless it was a felony charge or a condition of bond or sentencing that you cannot be in possession of a firearm, I can't see why they would take away your FOID or CCL for a theft charge. I am not asking, mind you but just making an observation.
xleonex Posted January 8, 2018 at 08:48 PM Author Share Posted January 8, 2018 at 08:48 PM It was a felony charge. It was all dropped and I'm exspunging.
xleonex Posted January 8, 2018 at 08:54 PM Author Share Posted January 8, 2018 at 08:54 PM I was given deferred prosecution and part of the courts agreement to drop the charges was I couldn't possess a firearm during the probation time. I have finished and all charges dropped. I am exspunging my arrest now.

lockman Posted January 8, 2018 at 10:42 PM Share Posted January 8, 2018 at 10:42 PM Ps my attorney is totally against ccl. He is very short on the subject An attorney that does not respect your fundamental rights would not be my first choice. The process you describe is a crappy type of deal. On its face it is basically a temporary plea of guilty in which you are under a sentence of probation, stay clean during your probation the original charges are dismissed. If I am innocent I would never accept probation, but threats and intimidation do work well for the prosecution.
InterestedBystander Posted January 9, 2018 at 12:46 AM Share Posted January 9, 2018 at 12:46 AM As part of the appeal did you include the paperwork saying probation is over, charges dropped, etc? Just because they were part of prior court orders, dont assume the ISP has current data. edit: PS Get a different attorney
xleonex Posted January 9, 2018 at 04:01 AM Author Share Posted January 9, 2018 at 04:01 AM Yes I did.. I included the rap sheet showing everything is dismissed. And the letter from the court in which I completed. I even included the copy of the person who took my cards.
