  1. Thank you sir for the information. I know it is not a forcible felony, not a firearm felony, not a drug related felony. He was an adult. I know exactly what the felony is (he told me specifically) but I do not think I should post it here. Seems it will be an informal appeal. Same process that I did a few years ago.
  2. I showed him everything that I put into my packet all those years ago. All the court papers. Papers showing the record had been sealed. Military papers. Work papers. Letters from multiple people including police and elected officials. Then my statement. Our problem is how to go about this. Felony was in Illinois. Now he is not an Illinois resident. Not applying for a FOID card. He just needs his firearm rights restored. He will email the ISP and find out what venue has jurisdiction and get the ball rolling. Sounds like things have changed since I went thru the process. I had a question sort of related. After having your firearm rights restored has anyone then tried to get their FFL or in another state applied for a suppressor?

  4. The felony occurred and he was sentenced here in Illinois. He now lives in another state. Actually a very free, Constitutional Carry state. FOID card revoked of course here in Illinois. He did apply for a FOID card some years later and of course was denied. At that time he was not sure how to proceed then life happened he got busy and is just now getting around to trying to get this process restarted.
  5. I went thru the process years ago. Hang in there gentlemen. Takes some time but you will get there. I have my FOID, my CCl and 5 other state CCLs. Now though I have a question that I have not seen covered so far. Please direct me to the relevant posts if this has been covered. I have a friend with a non violent non drug felony from early 2000s. No mental health aspects. No drug or alcohol related issues. He has no criminal issues since the felony. The records have been sealed. He holds a professional medical license in IL and his current state. He wants his firearm rights restored and of course there is no reason for that to not be granted. The problem is he is no longer an Illinois resident. How does he proceed at this point?
  6. I have a couple questions. Why do you even need to appeal? You no longer have a felony conviction. Since you have been pardoned and your felony has been expunged wouldn't you pass a NICS background check if you lived in another state and was purchasing a firearm? Once again, you no longer have a felony conviction. How in the world did you get a pardon? Feel free to PM me with an answer to this question. My non violent, non drug related felony from 1992 has been sealed, I have had my firearm rights restored and I have both a FOID and CCL. I never even considered a pardon as I considered it impossible.
  7. Very happy to say that I received my CCL yesterday, April 20 2019. So here is a timeline. Applied for my FOID in October of 2016. FOID denied December 2016. Filed my FOID appeal in March 2017. Won my appeal and received FOID in October 2018. Applied for my CCL in December 2018. CCL denied February 2019 and immediately appealed. CCL in hand April 20 2019. I am preparing a packet of material to send in when I apply via mail for my Florida carry license.
  8. Glock23 could you please expand on your comment. Are you saying that if a person has ever been convicted of a felony that they will not be issued a FOID?
  9. The letter should clearly state why you were denied and what your recourse will be depending upon the reason for the denial. This might be something simple or you might be in for a two year appeal process.
  10. I have a few questions that I cannot seem to find an answer to. Please forgive me if this has been discussed or answered. Let me set this up. The ISP has denied your application for a FOID. You appealed. Your appeal was denied by the ISP. You now decide to take this to the circuit court. By what set of laws or administrative rules or whatever does the circuit court follow to make a ruling regarding the issuance of the FOID? Is it all arbitrary? Is there a standard? Is there a time limit for after a disqualifying event you have remained event free that you receive a FOID? More important is where can a person read these standards?
  11. So I have a question for you Penumbra1811. What was the reason for the denial in court? PM me if you would like. Now a question for the group. When a person goes to court what is the law that the judge follows to decide to grant or deny restoration of rights? Surely there has to be some written standard to meet. Length of time since last conviction, job history, substance abuse issues etc, something other than the judges attitude that day.
  12. You know, this situation is just not fair or equal. Not sure if this is a policy or it was just talk but I remember reading something about gun crime in Chicago that goes something like this. If a person commits a violent act in Chicago with a firearm such as a robbery and this would be your first offense you can receive a deal where if you remain crime free for 18 or so months that all charges will be dropped. Please correct me if I am wrong with the details. If true this would be an unbelievably good deal. How many people on this board have committed a lot less of a serious crime and have remained law abiding citizens for decades but still have all kinds of grief getting a FOID or CCL? Sorry to take this off topic. This just is not equal protection under the law. Good luck with your case.
