Won my foid card appeal in appellate court and still no card

I had my foid card revoked over 25 years ago for possession of stolen car stereo equipment and recieved a felony and 1 yr court supervision no jail time.

 

I have been appealing this case for 2 years now and just won my case in the Illinois appellate court last month and got all my rights back, due to it was not a violent crime and was issued 1 year probation not jail, and proved im not a danger to society and all other criteria the state and federal government requested.

 

My lawyer sent all paperwork to the Illinois state police a month ago with judge stating remove my restrictions and issue my foid card back. And i still say denied on website.

 

My lawer and i have made numerous calls to the state police and can never get through and mailbox is always full.

 

I need to know who i can talk to so i can get my foid card asap.

Well its now March 5th and over a month since the State Police recieved my court order from the appellate court to give my foid card back, and no letter in mail, and no response to emails or phone calls made.

 

Gotta love when a citizen gets ordered to do something we have to do it asap or get arrested or jail time.

 

Can't wait till someday i can move out of currupt Illinois.

File a motion with the court to hold the State Police in contrempt for failing to follow the Court's order. That should get someone's attention.

 

Sadly I agree, if you have exhausted the 'polite' and normally prescribed course of action and assuming Molly was not able to get things rolling, it's time to step it up and ask the court hold the director of the ISP in contempt. It's really sad when it comes to this, but you have little options left if no one at the ISP is acting upon other formal requests to follow the court order.

When there is no individual in government personally accountable, this is what happens.

When monetary damages are not taken from individuals responsible, this is what happens.

You won a judgement over anonymous persons hidden in offices behind busy phone lines and email addresses who survive off of your money.

Contacted my attorney today, but he is in court defendind a murder.

 

So i asked his secretary about filing a motion for contempt against isp Director of illinois and she said we dont wanna piss the state police off. I was like "what" im p***** off cause they revoked it over 25 years ago and then last 2 years appealing it and i finally won, but now i have to wait untill they feel like looking at court order from appellate court.

 

So tired of Illinois politics, i need to get all this behind me and get my card and then i prolly will move to a more gun friendly state.

I get that you are anxious - I'd be anxious too, BUT be reasonable. Hopefully, you got put into the same hopper with everyone else, and that lead time is quoted as 90 days for EVERYONE, including YOU and ME. Unless the Judge specifically ordered the ISP to issue a new FOID card by a certain date, you can bet you are not getting any preferential treatment.

 

Now, the others here have said the same, and your attorney also told you to be patient. If you choose not to take the good advice you are receiving, you are perfectly in your rights to hire a new attorney and sue the ISP for dragging their feet, and see how far that takes you.

 

I'd guess that just about the time your check to the new attorney clears the bank, the new card will arrive and you will be whole again. But, what did you gain? Just chill.

I would suggest that if they demand 90 days to RENEW approved registrations, that you should expect at least the same time frame for a New or Restored registration. While I am happy to see your right restored, this does NOT mean you get a Free Line Hopper as well? When the 90 days expire, then start your inquiries.

Not sure where you are getting the 90 day requirement from. New applications are to be approved in 30 days and renewals within 60 business days.

 

Considering he lost his FOID over 25 years ago, I would think this would be a new Application. It should fall in the 30 day time frame.

 

Plus he has a Court order. That in itself should prompt the ISP to issue him his FOID card immediately.

When you say you are still denied on web site, did you reapply for a FOID?

If not I’d be doing that, if you can’t remember the old card, they probably can’t either.

Make a new account, apply, and see if they restrictions are lifted that way!

The clock starts when you do this I’m almost certain.

If it were me this is the line of progression I’d be doing.

Since your rights were restored by court ruling would you be able excercise the rights in another state? If so this may be incentive to move and get a carry license. Once a resident of another state with rights restored you would be legally exempted from needing a FOID card as a non-resident.

Well i guess my attorney sent some sort of letter giving them so many days to respond to original court order, and if they fail to respond to court order, then we are filing a law suit against isp.

Hopefully, they'll respond within the time frame and the lawsuit won't be necessary.
