Now that I'm about to get my record expunged, do I reapply or appeal the denial? Also can I answer "no" now about ever being charged with a felony? Also if you are granted an expungement then it is erased from all law enforcement and public records so there would be no reason for you to put yes to that question. And certainly re-apply. biggun 1 Posted October 26, 2018 at 03:54 AM Share Posted October 26, 2018 at 03:54 AM (edited) i was not convicted or charged with a felony.i was charged with domestic battery for pushing my 29 year old step daughter out the door.i called the police and they arrested me.charge was plea bargened down to disorderly conduct.because the origional charge was domestic battery illinois law sais no conceal for 5 years.i got it exponged.to answer the second part,yes the isp will mail you all paperwork related to the arrest so no records should exist.a cop friend of mine told me that police agency,s can be aware of the charges but due to the expongement they must ignore it. But, the FOID application asks if you've ever been "charged". check your record to make sure everything was cleared. If your charge goes away once completed then I would say you answer no. In this case, I would think you will have to appeal the denial. You will need to submit the appeal request, the waiver of investigation, and certified court documents showing the charges were cleared. Link to comment Share on other sites More sharing options...
