FOID card revoked - Alcohol rehab doubled as a mental health facility.

I was hoping to get a little advice on what to do about appealing my FOID card being revoked. I am currently in the process of fulfilling a life long dream of becoming a police officer, but need my FOID card back to continue with the application process. Here's the story: I checked into an alcohol rehab facility in June of 2016. I went through the initial check in process, but checked myself out shortly thereafter (within an hour). The facility felt like a mental hospital, I was not comfortable being there so I was out quickly. I did complete rehab at another facility that was solely for alcohol abuse and have been sober to this day (YAY!).

 

I received a letter from ISP saying my FOID card was revoked because I voluntary checked myself into a facility that doubled as a mental health facility. I am having problems with going though the forms to appeal this decision. The "mental health prohibitor" form is asking my current mental status and dates and details of "acts of suicide or violence". It's also asking me for a forensic evaluation from a psychiatrist. I can't wrap my mind around these forms because I didn't check myself in for mental health issues. I've never been suicidal or been violent at all, never been arrested for anything, never had a DUI. Am I to just put "N/A" next to all the questions asking about these mental episodes? Should I go see a psychiatrist to get evaluated (which seems extreme for my situation)? Should I be filling out the "non-mental health" appeal form? I do have 3 people that are writing letters to vouch for me.

 

If anyone has any insight on this I would greatly appreciate it. I am close to calling a lawyer for help, but would prefer to do this on my own. Any help or encouragement would be a tremendous help.

Can you get a signed statement or something showing you checked in for only the alcohol issue? Do you have any papers showing that was why you were there and showing the extremely short time period?

 

The hospital got back, they will not provide letter because I was not seen by a Dr. I went to the hospital and got my record of my check in/out, which does state in the "why are you here?" notes that I was there for drinking. I am not sure how to proceed. I am not sure if I should fill out the "mental health prohibitor" form with my appeal or should use another form. Any thoughts?

I suggest you file a 'records correction' appeal for your FOID because you admitted yourself for the drinking issue and not for treatment of a mental illness:

If you have a problem with alcoholism then you are not mentally sound enough (in my opinion) to own a firearm. I know people don't like hearing this. But guns are lethal weapons and for people who are mentally stable and not on drugs. The standard has been too low for too long and it's made the gun community look really bad. Frankly, I'm tired of it.

Probably should ban alcoholics from driving, marrying and having children too, oh and access to marijuana.

Most people I know were drunk when they got married.

We were doing keg stands in a church parking lot and that included the bride and groom.

To be young and stupid again just for a day.

I honestly can't think of anyone I know who was drunk when they got married, but then again no-one will make fun of you when the zombies come....

Hello all, just wanted to know what was the best way to get a status update on an appeal. I'm reading that some emailed ISP, but I can't seem to find the email address. I called ISP appeals and the phone kept ringing with no answer. Anything would help, thanks!

Ahhh, gee, do you even have any psychiatric records? It would probably be more expeditious to get the letter from the psychiatrist but it's not right that they are asking you to do it.

I don't have any records, but I guess I can make an appt to get the letter. It's a pain and it doesn't feel right, but I'll jump through the hoop. Thank you for the advice.

Is there a list of Dr.'s that are able to provide these evaluations? I've spoke with a few offices who do not. Seems like a very specific type of service.

Just wanted to update this thread that my FOID card appeal was successful and now have an active status on the ISP website.

 

Tips on help with this scenario: If you have an issue with a similar situation, your only hope is working with the hospital to have your name removed from the Department of Human Services list. A person seeking treatment for alcohol only is not considered a "patient" of a mental health facility and should not be reported to DHS. I was able to work with the hospital on having my name removed from this list, but you still have to go through the appeal process with ISP. My local state reps office was able to get in touch with their ISP contact in Springfield to expedite the appeal process after my name was removed. I highly recommend reaching out your rep once you have all your ducks in a row. Molly B. was also a great help during this as well. Also a big thank you to Grandpa59 for the links posted as that started me in the right direction for my end result. Greatly appreciated!

 

Timeline: Initial appeal sent Late March, card appeal approved 10/13.
