Asking for a friend.

 

Will a class “C” Misdemeanor get your IL CCW revoked?
The person was charged, booked and arrested with a pending court date.

Has no priors but they did refuse to provide ID to the police (the reason for the arrest).
Their thinking was 'this whole thing is blown all out of proportion', didn't want to jeopardize their CCW and wanted to remain silent.

They were not carrying at the time.

 

Anyone have experience with this?

Looking for some insight for them prior to them contacting an attorney.

And how would being honest up front effect the CCL anymore than what might happen now? lol

 

I would have preferred to obtain some relevant information to provide to him.

While you can judge him, even though you don't fully know the details of the situation, it would be more beneficial and helpful if you could address the question asked.

You have a friend who doesn’t respect law enforcement

And if you read these forums you’ll find that those with CCL and being legal gun owners are law abiding people, with respect for same

As for the complete situation, you posted it, you put it out there, if the answers from some don’t fit your narrative (Democrat’s) I see why you’ve gotten hurt!

As for the complete situation, you posted it, you put it out there, if the answers from some dont fit your narrative (Democrats) I see why youve gotten hurt!

If it's not violent (is any class c?) or drug and alcohol related they should be fine. But we did see other cases here that revoked FOID (and therefore CCW) not for the citation, but in the fine print of the conditions for supervision. So make sure their lawyer reads the fine print.

 

Some of us have to live in a Dem controlled police state where interaction with special Eddie's or Tom Dart's foot soldiers turn hostile very quickly. If you're conceal carrying a Terry stop will likely turn your legal carry gun into a certificate of destruction because even our state AG doesn't understand Cook/Chicago gun laws. Not every situation is what you imagine.

 

And no, I don't respect special Eddie. I don't respect Tom Dart either. Most of their force is led by nepotistic mouthbreathers abiding their time for a cush ghost payrole job and a fat taxpayer paid pension.

IANAL, but, police can only demand that you identify yourself if they have a reasonable suspicion you have commited, are committing or about to commit a crime. Even then you are not required to show an ID unless you are conducting an activity which requires ID, such as driving a car. There has to be more to this story.

Sovereign citizens don't need to provide ID ever. Or so I've heard some guy on YouTube say.

 

The only time you are required to "show id" is when engaged in otherwise unlawful conduct absent the license. In any other LEO encounter you may be required to verbally identify yourself, but are never "required by law" to produce documents showing identity. Since your not compelled to carry them, how can you be compelled to produce them?

He's under indictment for a crime. Misdemeanor is a crime. He hasn't been adjudicated yet so IMO his rights are temporarily suspended until his adjudication.

 

That being said, this is a total BS charge and should be thrown out if there's no reasonable suspicion for a stop and identify. We're either not being told whole story (like "was in a high crime neighborhood" or some other pretextual reason for the stop) or the SA's office is into recklessly prosecuting people.

 

Would like to know if he had ID on him and simply refused to show it, didn't have ID and refused to tell the cop who he is, or had ID, told cop who he is, identity verified, still arrested for the heinous crime of not carrying your government issued ID on his person.

Obstruction of identification. Idiot burglar who I witnessed burglarizing cars did this to the cops when I called and they ran into him while responding to the call. It got me out of having to testify as a witness heh.

 

I only ever see the Class C version when there's a companion charge like battery, UUW, or something like that. I have never seen anyone charged with this crime and only this crime. It reeks of BS. IANAL (who doesn't know that? Heh) but unless he was being a PITA to the cop just to be a thorn in the cop's posterior then I would advise a "not guilty" plea or even go talk to prosecutors himself and get the charge nol prossed or whatever (dismissed). Most people don't feel comfortable negotiating with experienced prosecutors but he has nothing to lose. I've done it several times and had "questionable" charges dismissed, citations dismissed because there's no case.

If you think you can't be arrested for simply refusing to produce ID, you haven't lived in the real world very long.

 

Many years ago, I had a girlfriend arrested for refusing to produce ID. She was doing nothing else at the time other than standing on the street as a party was coming to a close (the cops hadn't even been called on the party, they were just driving by). She was charged with disorderly conduct. My guess is the officers initially focused on her because she was young and attractive.

 

I had to walk between two police stations at 4am to try to bail her out, because I didn't drive at the time.

 

Charges were dropped in court on the first hearing.
