House Floor Amendment No. 2

 

Replaces everything after the enacting clause. Creates the Family and Personal Protection Act. Provides that the Department of State Police shall issue a license to carry a loaded or unloaded handgun to an applicant that meets specified qualifications, has provided the application and specified documentation, and has submitted the requisite fees. Provides that a license to carry a handgun entitles a licensee to carry a loaded handgun, either concealed or openly, on or about his or her person or in a vehicle, except in certain prohibited locations. Provides that the license shall be issued by the Department of State Police within 45 days of receipt from a sheriff and shall be valid throughout the State for a period of 5 years from the date of issuance. Provides for renewal of licenses. Establishes qualifications for licensees, certified firearms instructors, and instructor trainers. Provides that it is declared to be the policy of the State that it is an exclusive power and function of the State to regulate the possession and transportation of handguns and the issuance of licenses to carry handguns. Provides that with certain exceptions a home rule unit shall not regulate the possession or transportation of handguns. Provides that a home rule unit shall not regulate the number of handguns or require registration of handguns possessed by a person licensed under the Act. Provides that the provisions of the Act are severable. Amends the Freedom of Information Act. Prohibits from inspection and copying information about applications for licenses to carry a handgun and about license holders contained in the database created by the Family and Personal Protection Act, except as authorized by that Act. Amends the State Finance Act. Includes the Citizen Safety and Self-Defense Trust Fund as a special fund in the State treasury. Amends the Criminal Code of 1961. Provides that the statute concerning unauthorized possession or storage of weapons does not apply to a person acting lawfully under the Family and Personal Protection Act. Provides that certain unlawful use of weapons provisions relating to unlawful use of a weapon do not apply to or affect a licensee who has been issued a license to carry a handgun under the Family and Personal Protection Act, notwithstanding the provisions of that Act prohibiting the carrying of a handgun in certain places.

 

House Floor Amendment No. 3

 

Changes references from "handgun" and "weapon" to "concealed firearm". Provides that a concealed firearm licensee who is prohibited from carrying a concealed firearm in certain places shall be permitted to store that handgun or ammunition out of plain sight in a locked vehicle or within a locked compartment or container within his or her vehicle. Provides that a licensee shall not be in violation of the Family and Personal Protection Act while he or she is traveling along a public right of way that touches or crosses any of the prohibited premises if the handgun is carried on his or her person in accordance with the provisions of the Act or is being transported in a vehicle by the licensee in accordance with all other applicable provisions of law. Adds an immediate effective date to the bill.

HB1294 - Crim Cd Assault Weapons Prohibited

Synopsis As Introduced

 

Amends the Criminal Code of 1961. Provides that 90 days after the effective date of this amendatory Act, it is unlawful for any person within this State to knowingly manufacture, deliver, sell, purchase, or possess or cause to be manufactured, delivered, sold, purchased, or possessed a semi-automatic assault weapon, an assault weapon attachment, any .50 caliber rifle, or .50 caliber cartridge. Provides that beginning 90 days after the effective date of this amendatory Act, it is unlawful for any person within this State to knowingly manufacture, deliver, sell, purchase, or possess or cause to be manufactured, delivered, sold, purchased, or possessed a large capacity ammunition feeding device. Provides that these provisions do not apply to a person who possessed a prohibited weapon, device, or attachment before the effective date of this amendatory Act if the person has provided proof of ownership to the Department of State Police within 90 days after the effective date of this amendatory Act. Provides that on or after the effective date of this amendatory Act, such person may transfer such device only to an heir, an individual residing in another state maintaining that device in another state, or a dealer licensed as a federal firearms dealer. Specifies penalties for violations. Provides exemptions. Provides that the provisions of the Act are severable. Effective immediately.

 

 

 

 

 

HB1599 - Crim Cd Assault Weapons (Increased Penalties)

HB1855 - Firearm Owners Loss Theft

Amends the Criminal Code of 1961. Provides that if a person who possesses a valid Firearm Owner's Identification Card and who possesses or acquires a handgun thereafter loses or misplaces the handgun, or if the handgun is stolen from the person, the person must report the loss or theft to the local law enforcement agency within 72 hours after obtaining knowledge of the loss or theft. Requires an applicant for a Firearm Owners Identification Card (FOID) to be a resident of the State of Illinois. Requires the circuit court clerk to immediately notify the FOID Department of the Department of State Police of the adjudication of a person as a mental defective prohibited from firearm possession by the Act (instead of the court shall order the circuit court clerk to notify the Department), and forward a copy of the court order to the Department. Prohibits the court from ordering the Department to issue a FOID card in an appeal from a denial, revocation, or seizure of a person's FOID card by the Department, if the person is otherwise prohibited by federal law from acquiring, possessing, or using a firearm.

 

 

 

 

 

HB4717 - FOID Ammunition (Intra-State Shipping)

Provides that a resident purchasing ammunition within or outside the State of Illinois must provide the seller with a copy of his or her valid Firearm Owner's Identification Card and either his or her Illinois driver's license or Illinois State Identification Card prior to the shipment of the ammunition. Subject to appropriation, authorizes the Department of Public Health to make grants to trauma centers in high crime areas. Effective immediately.

Provides that a local government may not require registration, reporting of the sale or transfer of a firearm, or may not keep a firearms registry. Provides that any existing or future local ordinances or resolutions imposing any registration requirement on firearms and related items are invalid or void. Effective immediately.

 

 

 

 

 

HB5649 - Stun Gun Tasers Carry

Creates the Stun Gun and Taser Concealed Carry Licensing Act. Provides that the Department of State Police shall issue a license authorizing a person to carry or possess a concealed stun gun or taser on or about his or her person to an applicant who: (1) is at least 18 years of age; (2) possesses a valid Firearm Owner's Identification Card; (3) pays a license fee prescribed by the Department; (4) is not prohibited from possessing a firearm under the federal Gun Control Act of 1968, the Firearm Owners Identification Card Act, or the Deadly Weapons Article of the Criminal Code of 1961; and (5) demonstrates to the Department completion of a training course approved by the Department in the safe handling of a stun gun or taser and the laws concerning the justified use of force in defense of the person. Provides that a person issued a license to carry a concealed stun gun or taser may carry a stun gun or taser concealed upon his or her person and may use a stun gun or taser against another person in the exercise of reasonable force in defense of his or her person or in defense of other persons if the use of that force is justified under the Justifiable Use of Force Article of the Criminal Code of 1961. Prohibits the knowing carrying of a concealed stun gun or taser in certain places. Amends the Criminal Code of 1961. Provides that the unlawful use of weapons statute and the aggravated unlawful use of a weapon statute does not apply to or affect a licensee under the Stun Gun and Taser Concealed Carry Licensing Act, notwithstanding the provisions of that Act prohibiting the carrying of a concealed stun gun or taser in certain places, if the licensee meets the requirements of that Act. Effective immediately.

HB5831 - FOID Handgun Registration

Amends the Freedom of Information Act. Provides that names and information of people who have applied for or received certificates of handgun registration are exempt from public inspections and copying. Amends the State Finance Act. Creates the National Instant Criminal Background Check System Improvement Fund and the Illinois LEADS Information and Technology Improvement Fund. Amends the Firearm Owners Identification Act. Provides that the Act may now be cited to as the "Firearm Owners Identification Card and Certificate of Handgun Registration Act". Defines "certificate of handgun registration" and "handgun". Prohibits any person in the State from carrying or possessing a handgun without a certificate of handgun registration. Sets forth requirements concerning exemptions, applications for registration, registration fees, the distribution of moneys received from certain fees, and the denial of an application. Creates penalties for the possession of a handgun without a current certificate of registration, knowingly providing false or misleading information or evidence in connection with an application, and the failure to report to local law enforcement that a registered handgun is lost, stolen, missing, or destroyed. Sets forth procedures for the return of a certificate of registration for a handgun that is lost, stolen, or otherwise disposed of. Amends various Acts to make conforming changes.

 

 

Fiscal Note (Illinois State Police)

 

HB 5831 provides a monetary stimulus to register firearms within 90 days of the effective date of the bill which will create a huge influx of applications. The legislation requires the Illinois State Police to respond within 30 days after the initial application is received or allow for an appeal process if non-compliant. The Firearms Services Bureau (FSB) currently has a backlog in FOID application processing and the Relief Process for denied FOID applicants. This process will further contribute to the already dated and taxed system. Given the incentive to register firearms within the initial 90 day window, the tremendous impact of applications would be overwhelming to FSB given the current staffing levels are at a historic low while managing record levels of FOID card applications. In addition, the number of gun owners or the number of guns purchased in Illinois is unknown. Due to these factors, the Illinois State Police is unable to provide the fiscal impact. However, further research will determine IT infrastructure needs, staffing, equipment and ancillary office supplies to comply with the legislation as written. Without significant upfront resources, the department would be unable to comply with the legislation as written.

 

Balanced Budget Note (Office of Management and Budget)

 

HB 5831 as introduced has an unknown fiscal impact to the Illinois State Police. To fulfill the mandates included in this legislation, the Illinois State Police would need to spend approximately $3 million in developing and implementing a sufficient information technology system; have sufficient time to develop and implement the aforementioned system; and hire additional staff to carry out the duties mandated. While a revenue stream is identified for the FOID Fund and the National Criminal Instant Background Check System Improvement Fund and the Illinois LEADS Information and Technology Improvement Fund are established, it is unclear if sufficient revenue will be generated to support the mandated operations..

 

 

 

 

 

HB5913 - Crim Cd Firearm Transport

Amends the Criminal Code of 1961. Provides that a unit of local government, including a home rule unit, may not regulate the transportation of firearms and may not regulate the transportation of ammunition, components, accessories, or accoutrements for firearms. Provides that the provisions of any ordinance or resolution adopted by any unit of local government that imposes restrictions or limitations on the transportation of firearms and ammunition, components, accessories, and accoutrements of firearms in a manner other than those that are imposed by this amendatory Act are invalid and all those existing ordinances and resolutions are void. Provides that any unit of local government which is found to have violated this provision is liable for all costs, attorney's fees, actual, and treble damages. Provides that this provision is a limitation of home rule powers under subsection (h) of Section 6 of Article VII of the Illinois Constitution. Effective immediately.

House Committee Amendment No 1

 

Replaces everything after the enacting clause. Amends the Criminal Code of 1961. Changes the exemption from the unlawful use of weapons statute and the aggravated unlawful use of a weapon statute for military re-enacting. Provides that the exemption applies to a person possessing a rifle with a barrel or barrels less than 16 inches in length if: (A) the person has been issued a Curios and Relics license from the U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives; or ( B ) the person is an active member of a bona fide, nationally recognized military re-enacting group and the modification is required and necessary to accurately portray the weapon for historical re-enactment purposes; the re-enactor is in possession of a valid and current re-enacting group membership credential; and the overall length of the weapon as modified is not less than 26 inches. Retains provision that during transportation, any such weapon shall be broken down in a non-functioning state, or not immediately accessible.

As mentioned Wednesday, I'll be away from the forum today. Since Wisconsin trusts me enough to allow the full exercise of my rights, I'll be giving my PA carry permit a workout this weekend.

 

For those available to keep on eye on things, the House will be the place to be. I don't know that there will be movement on those bills, but I would not expect to see any real motion on the bills in the Senate today.

As I understand it, his temporary replacement will be picked by the county committeemen of the counties in his district. One thought is that they will pick Brad Halbrook, the recently elected R candidate for the new 110th district to serve in the remainder of this session and the veto session in Oct.

 

Brad's current home (he'll have to move to the 110th soon) is about 2 miles as the crow flies from where I sit right now. Brad and I have talked gun rights several times. He will be fine on LTC and all other aspects of gun issues for us.

72 right?(and probably a few more for good luck?)

 

As Todd has said before, sponsors are nice, but not essential. It is the vote that counts.

 

Obviously, the nice thing about co-sponsors are, they are less abt to stab us in the back when the vote finally comes. The more co-sponsors we get, the more we can focus on those question marks.

is there any reason we are not watching SB 3772 my senator Dale Righter posted on his FB page tonight that he is a sponsor for it and was asking for support.

 

 

It's gone to subcommittee. That usually doesn't bode well. We'll see if it gets out of there. If so, we get on it. Dale is good on all 2A issues. He'll be one of the first to sponsor a House bill if we can get it sent to the Senate. I'm encouraged with the number of sponsors that HB 5745 is picking up.

I think that any "public' institution, including schools should be civilly on the hook if someone is injured and an otherwise licensed CCL holder is present and could have stopped it if they had been armed.

 

 

 

I talk about this with my wife a lot, she is a teacher in a school that is too small to have an SRO or other LEO presence. Even with Conceal Carry passing in Illinois she would still be helpless to stop any sort of school shooting type situation from going down.

IIRC, government essentially has complete immunity for everything except for what it agrees to be liable for.

 

I am not sure it is all that great of an idea to try and add to the liability of any entity, government or private, based on some presumed better result that might have occurred if something different than what happened might have happened.

I am not sure it is all that great of an idea to try and add to the liability of any entity, government or private, based on some presumed better result that might have occurred if something different than what happened might have happened.

 

We do that to individuals. Have a pool? Better take reasonable precautions to prevent the neighbor kid from falling in and drowning.

I can see an argument for keeping guns out of Court Houses, Police Stations, Jails etc places where you have LOTS of LEO's to protect you. But most schools at best have 2 or 3 SRO's. A lot still have none. Just like the optional arming pilots after 9/11 as a last line of defense we should have been arming Teachers after the long list of recent school shootings.

is there any reason we are not watching SB 3772 my senator Dale Righter posted on his FB page tonight that he is a sponsor for it and was asking for support.

 

There are diiferent threads for watching bills in different ways.

 

Earlier this year we developed a list which you can find in post #89 of this thread. Since we're still in the same 97th General Assembly as 45superman's list, those 2 can be taken together as a pretty comprehensive list of bills that might make it through committee and end up on the House or Senate calendar. SB3772 is included in this.

 

The daily Illinois General Assembly update threads trim it down to only those bills that are in a committee scheduled for that day or are on the House or Senate calendar that day. There is more immediacy about the daily threads.
