In the House Rules Committee, House Floor Amendment No 2 to HB4456 - FOID Card Act Private Sale was approved for consideration and the bill added cosponsor William Davis. This bill has changed purpose since adoption of Amendment No 1 but I am leaving it on our list as a bill we oppose since it would reduce availability of a FOID card under some circumstances.

 

The sponsor of HB4393 - Criminal Law Tech moved to table this bill that proposed to create a registry of persons convicted of certain firearm violations. This may be a direct result of an Illinois Carry call to action in opposition of the bill.

House Floor Amendment No. 2

 

Replaces everything after the enacting clause. Creates the Family and Personal Protection Act. Provides that the Department of State Police shall issue a license to carry a loaded or unloaded handgun to an applicant that meets specified qualifications, has provided the application and specified documentation, and has submitted the requisite fees. Provides that a license to carry a handgun entitles a licensee to carry a loaded handgun, either concealed or openly, on or about his or her person or in a vehicle, except in certain prohibited locations. Provides that the license shall be issued by the Department of State Police within 45 days of receipt from a sheriff and shall be valid throughout the State for a period of 5 years from the date of issuance. Provides for renewal of licenses. Establishes qualifications for licensees, certified firearms instructors, and instructor trainers. Provides that it is declared to be the policy of the State that it is an exclusive power and function of the State to regulate the possession and transportation of handguns and the issuance of licenses to carry handguns. Provides that with certain exceptions a home rule unit shall not regulate the possession or transportation of handguns. Provides that a home rule unit shall not regulate the number of handguns or require registration of handguns possessed by a person licensed under the Act. Provides that the provisions of the Act are severable. Amends the Freedom of Information Act. Prohibits from inspection and copying information about applications for licenses to carry a handgun and about license holders contained in the database created by the Family and Personal Protection Act, except as authorized by that Act. Amends the State Finance Act. Includes the Citizen Safety and Self-Defense Trust Fund as a special fund in the State treasury. Amends the Criminal Code of 1961. Provides that the statute concerning unauthorized possession or storage of weapons does not apply to a person acting lawfully under the Family and Personal Protection Act. Provides that certain unlawful use of weapons provisions relating to unlawful use of a weapon do not apply to or affect a licensee who has been issued a license to carry a handgun under the Family and Personal Protection Act, notwithstanding the provisions of that Act prohibiting the carrying of a handgun in certain places.

 

House Floor Amendment No. 3

 

Changes references from "handgun" and "weapon" to "concealed firearm". Provides that a concealed firearm licensee who is prohibited from carrying a concealed firearm in certain places shall be permitted to store that handgun or ammunition out of plain sight in a locked vehicle or within a locked compartment or container within his or her vehicle. Provides that a licensee shall not be in violation of the Family and Personal Protection Act while he or she is traveling along a public right of way that touches or crosses any of the prohibited premises if the handgun is carried on his or her person in accordance with the provisions of the Act or is being transported in a vehicle by the licensee in accordance with all other applicable provisions of law. Adds an immediate effective date to the bill.

HB1294 - Crim Cd Assault Weapons Prohibited

Amends the Criminal Code of 1961. Provides that 90 days after the effective date of this amendatory Act, it is unlawful for any person within this State to knowingly manufacture, deliver, sell, purchase, or possess or cause to be manufactured, delivered, sold, purchased, or possessed a semi-automatic assault weapon, an assault weapon attachment, any .50 caliber rifle, or .50 caliber cartridge. Provides that beginning 90 days after the effective date of this amendatory Act, it is unlawful for any person within this State to knowingly manufacture, deliver, sell, purchase, or possess or cause to be manufactured, delivered, sold, purchased, or possessed a large capacity ammunition feeding device. Provides that these provisions do not apply to a person who possessed a prohibited weapon, device, or attachment before the effective date of this amendatory Act if the person has provided proof of ownership to the Department of State Police within 90 days after the effective date of this amendatory Act. Provides that on or after the effective date of this amendatory Act, such person may transfer such device only to an heir, an individual residing in another state maintaining that device in another state, or a dealer licensed as a federal firearms dealer. Specifies penalties for violations. Provides exemptions. Provides that the provisions of the Act are severable. Effective immediately.

 

 

 

 

 

HB1599 - Crim Cd Assault Weapons (Increased Penalties)

Amends the Criminal Code of 1961. Provides that if a person who possesses a valid Firearm Owner's Identification Card and who possesses or acquires a handgun thereafter loses or misplaces the handgun, or if the handgun is stolen from the person, the person must report the loss or theft to the local law enforcement agency within 72 hours after obtaining knowledge of the loss or theft. Replaces everything after the enacting clause. Amends the Firearm Owners Identification Card Act. Requires an applicant for a Firearm Owners Identification Card (FOID) to be a resident of the State of Illinois. Requires the circuit court clerk to immediately notify the FOID Department of the Department of State Police of the adjudication of a person as a mental defective prohibited from firearm possession by the Act (instead of the court shall order the circuit court clerk to notify the Department), and forward a copy of the court order to the Department. Prohibits the court from ordering the Department to issue a FOID card in an appeal from a denial, revocation, or seizure of a person's FOID card by the Department, if the person is otherwise prohibited by federal law from acquiring, possessing, or using a firearm.

Provides that a resident purchasing ammunition within or outside the State of Illinois must provide the seller with a copy of his or her valid Firearm Owner's Identification Card and either his or her Illinois driver's license or Illinois State Identification Card prior to the shipment of the ammunition. Provides that a local government may not require registration, reporting of the sale or transfer of a firearm, or may not keep a firearms registry. Provides that any existing or future local ordinances or resolutions imposing any registration requirement on firearms and related items are invalid or void. Effective immediately.

 

 

 

 

 

HB5649 - Stun Gun Tasers Carry

Provides that the Department of State Police shall issue a license authorizing a person to carry or possess a concealed stun gun or taser on or about his or her person to an applicant who: (1) is at least 18 years of age; (2) possesses a valid Firearm Owner's Identification Card; (3) pays a license fee prescribed by the Department; (4) is not prohibited from possessing a firearm under the federal Gun Control Act of 1968, the Firearm Owners Identification Card Act, or the Deadly Weapons Article of the Criminal Code of 1961; and (5) demonstrates to the Department completion of a training course approved by the Department in the safe handling of a stun gun or taser and the laws concerning the justified use of force in defense of the person. Provides that a person issued a license to carry a concealed stun gun or taser may carry a stun gun or taser concealed upon his or her person and may use a stun gun or taser against another person in the exercise of reasonable force in defense of his or her person or in defense of other persons if the use of that force is justified under the Justifiable Use of Force Article of the Criminal Code of 1961. Prohibits the knowing carrying of a concealed stun gun or taser in certain places. Amends the Criminal Code of 1961. Provides that the unlawful use of weapons statute and the aggravated unlawful use of a weapon statute does not apply to or affect a licensee under the Stun Gun and Taser Concealed Carry Licensing Act, notwithstanding the provisions of that Act prohibiting the carrying of a concealed stun gun or taser in certain places, if the licensee meets the requirements of that Act. Effective immediately.

HB5831 - FOID Handgun Registration

Amends the Freedom of Information Act. Provides that names and information of people who have applied for or received certificates of handgun registration are exempt from public inspections and copying. Amends the State Finance Act. Creates the National Instant Criminal Background Check System Improvement Fund and the Illinois LEADS Information and Technology Improvement Fund. Amends the Firearm Owners Identification Act. Provides that the Act may now be cited to as the "Firearm Owners Identification Card and Certificate of Handgun Registration Act". Defines "certificate of handgun registration" and "handgun". Prohibits any person in the State from carrying or possessing a handgun without a certificate of handgun registration. Sets forth requirements concerning exemptions, applications for registration, registration fees, the distribution of moneys received from certain fees, and the denial of an application. Creates penalties for the possession of a handgun without a current certificate of registration, knowingly providing false or misleading information or evidence in connection with an application, and the failure to report to local law enforcement that a registered handgun is lost, stolen, missing, or destroyed. Sets forth procedures for the return of a certificate of registration for a handgun that is lost, stolen, or otherwise disposed of. Amends various Acts to make conforming changes.

 

 

Fiscal Note (Illinois State Police)

 

HB 5831 provides a monetary stimulus to register firearms within 90 days of the effective date of the bill which will create a huge influx of applications. The legislation requires the Illinois State Police to respond within 30 days after the initial application is received or allow for an appeal process if non-compliant. The Firearms Services Bureau (FSB) currently has a backlog in FOID application processing and the Relief Process for denied FOID applicants. This process will further contribute to the already dated and taxed system. Given the incentive to register firearms within the initial 90 day window, the tremendous impact of applications would be overwhelming to FSB given the current staffing levels are at a historic low while managing record levels of FOID card applications. In addition, the number of gun owners or the number of guns purchased in Illinois is unknown. Due to these factors, the Illinois State Police is unable to provide the fiscal impact. However, further research will determine IT infrastructure needs, staffing, equipment and ancillary office supplies to comply with the legislation as written. Without significant upfront resources, the department would be unable to comply with the legislation as written.

 

Balanced Budget Note (Office of Management and Budget)

 

HB 5831 as introduced has an unknown fiscal impact to the Illinois State Police. To fulfill the mandates included in this legislation, the Illinois State Police would need to spend approximately $3 million in developing and implementing a sufficient information technology system; have sufficient time to develop and implement the aforementioned system; and hire additional staff to carry out the duties mandated. While a revenue stream is identified for the FOID Fund and the National Criminal Instant Background Check System Improvement Fund and the Illinois LEADS Information and Technology Improvement Fund are established, it is unclear if sufficient revenue will be generated to support the mandated operations..

 

 

 

 

 

HB5913 - Crim Cd Firearm Transport

Amends the Criminal Code of 1961. Provides that a unit of local government, including a home rule unit, may not regulate the transportation of firearms and may not regulate the transportation of ammunition, components, accessories, or accoutrements for firearms. Provides that the provisions of any ordinance or resolution adopted by any unit of local government that imposes restrictions or limitations on the transportation of firearms and ammunition, components, accessories, and accoutrements of firearms in a manner other than those that are imposed by this amendatory Act are invalid and all those existing ordinances and resolutions are void. Provides that any unit of local government which is found to have violated this provision is liable for all costs, attorney's fees, actual, and treble damages. Provides that this provision is a limitation of home rule powers under subsection (h) of Section 6 of Article VII of the Illinois Constitution. Effective immediately.

In the Senate yesterday, Senate Amendment No 1 to SB0681 - Regulation Tech was adopted, making this an intra-state ammunition shipping bill. The bill subsequently passed 47/6/1 and has been sent to the House.

 

HB4063 is now sponsored in the Senate by Dale Righter, and in the usual course of business H4901 = Crimial Law Tech has been referred to Senate Assignments.

HB5151 - Premises Liability Firearm Range

Amends the Premises Liability Act. Provides that an owner or operator of a firearm range placed in operation after January 1, 1994 is immune from criminal liability and is not subject to any action for public or private nuisance or trespass arising out of or as a consequence of noise or sound emissions resulting from the normal use of the firearm range if: all areas from which a firearm may be properly discharged are at least 500 (rather than 1,000) yards from any occupied permanent dwelling on adjacent property; or the firearm range met those requirements at the time the range began its operation and subsequently an occupied permanent dwelling on adjacent property was built within 500 (rather than 1,000) yards from an area of the range from which a firearm may be properly discharged. Call me the PITA but I don't like the FOID ammo bill SB0681 because it requires ammo to be shipped to the address on your drivers license or FOID. Some places now require that when you buy ammo but most don't, so I usually have ammo shipped to my work. I know it won't sit in my condo's lobby all day that way and I won't have to go potentially pick it up at the post office(which is only open till 5 during the week) or the UPS sorting facility. Unless you live in a prohibited area like Chicago I don't see why there should be any restriction on where you want your ammo shipped. If I want the stuff shipped to my families farm in Wisconsin or a summer home in Florida I should damn well be able to do it.

 

 

OK I am done with my little minirant, looks like I will be waiting at the post office on Saturday morning more often now.

Well damn here I was mr. big bad lawbreaker shipping ammo to my place of business(Call in the SWAT team!); I thought the whole section was originally an insert not an edit. If thats the case then I would say that section needs to be changed. I still think its wrong to restrict where you can have ammo shipped; especially with the prospect of an added 2% tax on ammo in Illinois.

 

Alas I am too law abiding to ignore even BS laws like this, guess all future ammo whether I like it or not goes to the house.

In order to get partof this passed, we had to make a few consessions as anti gunnrs are concerned someone with a foid card would buy ammo for someone else and have it shipped to another address.

 

Its a small price to pay to be able to order ammo on line

 

 

 

I don't see why you should even need to show FOID to buy ammo. I wish they would just treat ammo like any other object ordered online like knives, hand tools, axes, etc.

 

Personally; unless the 2% tax passes this will discourage me from buying ammo online for the reasons I have already listed. I think a lot of you are probably in the same boat not wanting hundreds of dollars of ammo sitting on your front porch or out in the rain.

I hate this state. So now my CMP orders can't come to work? I need to take time out of my day to go to the UPS office and pick it up?

 

I can understand the concern, but it's illogical. But I am preaching to the choir here right. Ugh. This is going to tick me off to no end. :headbang1: I wish I was rich so I could make more of a difference by pumping millions into the gun lobby in this state. I need to win that lottery... if it's even still going on.

There is a Task Force, not a "Republican" Task Force. They are still in process, I think. I don't recall if/when they'll be meeting next or what their current due date is.

There are no strip clubs in Chicago. At least not real ones.

 

 

THAT is one thing you have to go down state for, the best we have up here is Pole-Katz...not all that good.

Big Al's should be the official strip club of Illinois Carry......

 

Anyways; with 3 republicans away I can imagine we are not going to see any of the "good" bills coming up today for a vote?

I hate this state. So now my CMP orders can't come to work? I need to take time out of my day to go to the UPS office and pick it up?

 

I can understand the concern, but it's illogical. But I am preaching to the choir here right. Ugh. This is going to tick me off to no end. headbang1.gif I wish I was rich so I could make more of a difference by pumping millions into the gun lobby in this state. I need to win that lottery... if it's even still going on.

 

 

Did you even read Federal Farmer's response????? Delivery to the address on your FOID or DL is already part of the FOID law and has been for several years. If you have an agreement with your shipper, then that won't change.

 

Good Gravy guys!! Read all the way through a thread before flying off the handle about something. Also, learn to read the bills and amendments. When you read them, they are generally going to quote the current law and put changes in as underlined text. Current law that is struck through is law that is being taken out. It always pays to go read the proposed bills and amendments yourself rather than rely on someone else to do it.

 

The FOID card is in our sights, but right now there are other things to shoot at that make a lot more sense in restoring our rights.
