kdn Posted June 6, 2019 at 01:16 AM Share Posted June 6, 2019 at 01:16 AM Hello all. I am seeking advice about my FOID application and I hope that I have come to the right place. I tried to call and email the ISP and, well, you know how that worked out. They don't seem to answer the phone or respond to emails.Anyway, here is my problem. I was denied a foid card in December last year. I then hired an attorney and, in May, the Circuit Court of Madison Count granted my petition for relief and instructed the ISP to issue my FOID card. So far so good, but I don't know what happens now. I tried to fill out a new application, (is that even necessary?) and the website won't let me. It keeps sending me to the page where it says I am denied. I guess my question is, Do I need to do anything? Or do I wait a month or a year until the notification changes to under review or approved or?Any advice would be greatly appreciated. Thanks in advance. MrSmallie Posted June 6, 2019 at 03:03 AM Share Posted June 6, 2019 at 03:03 AM (edited) There are other threads with exact same issue and the resolution. Short answer: Wait 90 days. If status isn't updated yet, contact your attorney and/or State Rep. Edit: Contacting the ISP via phone, email or mail is basically just wasting your time. Molly B. Posted June 6, 2019 at 05:26 PM Share Posted June 6, 2019 at 05:26 PM You cannot re-apply while your status is still listed as denied. Was a copy of the judge's order delivered to the ISP? Contact the assistant from Attorney General's office that represented the state and make sure ISP received a certified copy. Ask AAG when you can expect your FOID to be issued. kdn Posted June 7, 2019 at 03:09 AM Author Share Posted June 7, 2019 at 03:09 AM (edited) Hello MollyYes, my attorney faxed and mailed a copy of the court order to the ISP along with a cover letter and a copy of my relief petition. Should I still contact the AAG? The district attorney for the county of Madison represented the state, but they did not challenge the petition.Thank you for the response. I forgot to add that my attorney also sent the above mentioned paperwork to the district attorneys office. In that case you might want to check with the State's attorney first, and if you don't get success there - have your attorney contact the acting director of the ISP Brendan Kelly. kdn Posted June 7, 2019 at 03:26 AM Author Share Posted June 7, 2019 at 03:26 AM Forgive me if this question sounds foolish, but can the ISP simply ignore the court ordered relief and not issue the FOID? Or is this a way to light a small fire under their tail? It seems odd that they can take 3 or more months to issue after an order of relief is sent to them. Molly B. Posted June 7, 2019 at 03:33 AM Share Posted June 7, 2019 at 03:33 AM They come back with the same old argument - 'there is no time frame to process appeals or court orders'. Look up IllinoisCarry member 'Kosta'. I think he waited 90 days after a court order? http://illinoiscarry.com/forum/index.php?showtopic=71341&p=1210183

"Your honor, based on researching for this case, it appears that even after receiving court orders the ISP continues to delay the issuance of cards due to their claim that "there is no time frame to process appeals or court orders". We respectfully request that the state be given a 30 day deadline as written in the FOID act, and that they be considered in contempt if they fail to do so."
