lockman Posted January 19, 2009 at 01:51 PM Share Posted January 19, 2009 at 01:51 PM http://opencarry.mywowbb.com/forum16/20062.html (discussion thread here) Openly carrying a loaded cap & ball revolver is not a firearm under federal and DC code. An inquiry to confirm that resulted in this email from the DC gun control unit: Got my response to the ask the chief e-mail. Just as I suspected antique firearms, or replicas thereof are not firearms: Hello Mr. xxxxxxxxxxxxxx This email is in response to your inquiry regarding antique firearms. An antique firearm in the District of Columbia is defined as any firearm (including any firearm with a matchlock, flintlock, percussion cap, or similar type of ignition system) manufactured in or before 1898, and any replica of any such firearm. As long as it has not been designed or redesigned for using rim-fire or conventional center-fire fixed ammunition. Furthermore, it is illegal for any individual to carry within the District of Columbia a rifle or shotgun. If your weapon meets the above definition for an antique firearm, then it is not considered a firearm, rifle, or shotgun. Antique weapons need not be registered in the District of Columbia, therefore you will not be subject to any criminal penalties. If you have any further questions, please feel free to contact me at Colin.Hall@dc.gov or call a member of Firearms Registration/Gun Control at (202) 727-4275. richp Posted January 19, 2009 at 06:59 PM Share Posted January 19, 2009 at 06:59 PM Hi, I lived in the DC suburbs and worked in the District for 6 years. Thinking of doing this and coming away unscathed is a pipedream, and a personal disaster waiting to happen. I promise you that regardless of the legality of a cap and ball pistol itself, you would not be able to carry one openly there without being stopped by the cops. You'd likely be arrested for disturbing the peace. And if you were, you'd be slammed into a jail that maybe only Lockman can imagine for its hellishness. By the time you got a lawyer and sorted things out, you'd be out a lot of money, as well as the virginity of certain bodily orfices. A word to the wise.... lockman Posted January 19, 2009 at 10:39 PM Author Share Posted January 19, 2009 at 10:39 PM Rich Phillips Rich, Being arrested for lawful conduct equals = cash cow. This is a new way to earn a living and advance civil rights at the same time. It is not for everybody but thank goodness for those that have the time and patience. richp Posted January 19, 2009 at 11:51 PM Share Posted January 19, 2009 at 11:51 PM Hi Lockman, I had another angle in mind. I have professional, up-close experience with the DC Jail, and it's on a par with what we hear about Cook County Jail. Dominated by gangs. Pervasive inmate-on-inmate violence. Lack of staff control. No thinking person would deliberately risk being booked in there, even for a few hours until you could bail out. Suppose for a moment a person wanted to conjure up a civil lawsuit on firearms ownership, with even the possibility of monetary compensation. There are far better ways, than to sign up for the personal danger presented by being arrested and likely going into one of those heck-holes. FWIW. lockman Posted January 20, 2009 at 12:01 AM Author Share Posted January 20, 2009 at 12:01 AM Rich Phillips I add the caveat, “if it does not kill you it will make you stronger and monetarily well off”.
richp Posted January 20, 2009 at 01:09 AM Share Posted January 20, 2009 at 01:09 AM Hi Lockman, You must be made of sterner stuff than me. I can think of no amount of money that would make me whole, if I was jailed and assaulted, and/or sexually violated in a violent and brutal manner. That's a high probability event in the DC or Cook County jails, for someone with no gang protection or criminal sophistication. Ask any woman who has been raped what dollar figure would restore her..... FWIW. Rich Phillips
BShawn Posted January 20, 2009 at 09:42 AM Share Posted January 20, 2009 at 09:42 AM I had a friend inquiring on this issue in relation to IL... (ie... can you carry an "antique", as not considered a "firearm", here in IL?)
