Miked0292 Posted October 17, 2017 at 04:39 PM Share Posted October 17, 2017 at 04:39 PM Well little over 2 and half years ago I got the letter saying I need to turn in my FOID card as it has been revoked due to a felony (theft) case on going. Fast forward I complete the case and the judge grants the case is closed and expungment is given. I get a letter from the DuPage Co. State's Attorney stating that the case is over and my record shall be expunged. Call up the ISP and ask what do I need to send to get my card back as now its off my record, lady explains the sheets need and what not , The wavier, and request for appeal, along with documents to prove its been expunged. Easy enough , I gather the paperwork and send it off that was 3 weeks ago now and no reply or nothing. Just wondering what the heck should take so long? Molly B. Posted October 17, 2017 at 04:48 PM Share Posted October 17, 2017 at 04:48 PM I am sure they will do the background checks again and so forth, they have to verify the court documents etc., and they have many folks in line ahead of you. If your status has not been upgraded to 'active' within 30 days, please let me know.
Glock23 Posted October 17, 2017 at 04:51 PM Share Posted October 17, 2017 at 04:51 PM (edited) Bureaucracy, plain and simple. There's a 30 day time limit on FOID applications, but I don't know if that applies to appeals. And the only "response" you'll see (assuming they approve your appeal) is likely to be the status when you log into the ISP portal. Cordell34 Posted October 17, 2017 at 05:27 PM Share Posted October 17, 2017 at 05:27 PM Have you received the letter From ISP stating that your expungement has been received and will be enforced??? It takes about 90 days for everything to be pushed through the system. The Court Order is great but ISP has to do Their work as far as sending the Order to expunged through To all of the Background Check systems. You’ll be fine. I have received no such letter from the ISP, and my case was dismissed/expunged on July 31st, so I am close approaching that 90 day mark. And when I login to the ISP FSB log in it just show Revoked so that why i decided to ask my question on here to see if I should wait a bit more or start poking around as to what might be holding it up.
