BoJo Posted March 3, 2018 at 02:40 PM Share Posted March 3, 2018 at 02:40 PM I applied for my foid card 6/22/17 and got denied based on a felony charge Iowa, that was actually a simple misdemeanor with a deferred judgement with 9 months non-reporting supervision; the court expunged the case upon satisfactory completion on 9/29/17. My question is why would I be denied based on a felony charge? And has anyone had a similar experience and was allowed to get their foid card? mic6010 Posted March 3, 2018 at 02:45 PM Share Posted March 3, 2018 at 02:45 PM My question is why would I be denied based on a felony charge?Because if you have something on your record that's coming up as a felony then you can't legally own a firearm, in any state. BoJo Posted March 3, 2018 at 02:51 PM Author Share Posted March 3, 2018 at 02:51 PM (edited) The court records show that i was never charged with a felony. I spoke with my atty in both my case in Iowa and my foid appeal and he was perplexed at the fact that I was denied by the FSB. Doesnt make sense at all. I was able to own firearms whilst I lived in Iowa and for the duration of the supervision, only when I moved back to Illinois did I run into an issue. Glock23 Posted March 3, 2018 at 03:37 PM Share Posted March 3, 2018 at 03:37 PM (edited) Maybe the initial arrest was for a felony but it was only charged as a misdemeanor. Or maybe that misdemeanor in Iowa is a felony in Illinois. Edited March 3, 2018 at 03:38 PM by Glock23

Cerus Posted March 3, 2018 at 09:51 PM Share Posted March 3, 2018 at 09:51 PM Should probably start a new thread or post in one of the CCL threads rather than hijacking one on a completly different issue.

BoJo Posted March 5, 2018 at 04:45 AM Author Share Posted March 5, 2018 at 04:45 AM Bump. Question still stands, has anyone prevailed with proving that the record used to disqualify was false? In my case, in neither state the charge was a felony or a restricting offense but still the FSB denied me my permission slip to utilize my rights. Yes, we've seen wrongful denials and appeals were submitted, FOID cards were issued. What did the denial letter list as the reason for the denial? Did you submit an appeal? When? Was it a Records Correction appeal?
Monty80 Posted March 5, 2018 at 07:36 AM Share Posted March 5, 2018 at 07:36 AM I was denied a FOID based on the wrong disposition being entered into the computer system. Filed my appeal with all the revelant documentation and 180 days after that, I had my FOID. When I applied for my CCL, I was approved on day 31 and in hand in 33 days. Keep fighting them. That was a little over a month ago. We've seen these take anywhere from 6 mos. to a year, sorry to say. The CCL appeal department director does not seem to be one to care much about how long these take.
