County officials: Pistol permit re-certification a 'mess'

ALBANY Gov. Andrew Cuomo is being pressed by county clerks across New York to respond to a list of questions they have concerning the administration of updating pistol permits for hundreds of thousands of legal gun owners.

 

Those who obtained their pistol permits before January 2013 are facing a Jan. 31 deadline to recertify. The mandate resulted from Cuomo's gun control legislation, known as the New York SAFE Act, rushed through the Legislature nearly five years ago.

 

"There are so many unanswered questions now that this has become a big mess," said Niagara County Clerk Joseph Jastrzemski. "The biggest question we have is: What is the due process going to be if someone misses the recertification deadline date?"

The letter from the New York State Association of County Clerks asks Cuomo and several other top state officials to identify the agency that will be in charge to "secure" weapons from those gun owners who fail to update their permits.

 

They also want the state officials to identify the party that will be responsible for notifying gun owners that they are no longer in compliance with the SAFE Act requirements.

In Otsego County, the pistol permits are administered by the sheriff's department. Sheriff Richard Devlin Jr. has said he has no plans to deploy his deputies to notify gun owners that their permits have lapsed. He has said he has used social media posts to remind gun owners of the looming deadline.

 

Jastrzemski said he believes the clerks have no responsibility to notify gun owners that their certifications have lapsed.

 

"This was not an initiative of the clerks," he noted. "This has been so poorly run that I have been out all over the place to help get people recertified."

The SAFE Act was passed as an emergency measure enacted by Cuomo in the wake of the massacre at a Connecticut elementary school in December 2012.

 

He has repeatedly insisted that the law has enhanced public safety in the state, though the legislation has been criticized by several upstate sheriffs as burdensome for law-abiding gun owners.

 

"Nobody took the time or made the effort to find out what all this would entail," said Tom King, director of the New York State Rifle and Pistol Association, a gun owners group.

 

"This was a case of 'Let's get this done, and we will figure it out later.' But the details are now coming back to bite them in the butt."

Easy solution: if you’re a New York gun owner, refuse to comply with the recertification.

 

If you’re a New York sheriff, refuse to enforce the law, and arrest any state officials who attempt to do so in your jurisdiction.

 

These people can only be stopped by mass non-compliance, and local officials vigorously preventing state officials from enforcing the law.

As a former New Yorker, I think mass non-compliance is working on a few parts of the safe act. Mostly around registering “assault weapons” and personal sales among friends and family.

 

The pistol permit is a dicey issue unless you are prepared to be a test case.

 

NYS law requires a pistol permit for any type of handgun ownership. Your handguns are all “listed” on your permit. When you sell a handgun, it gets moved to new owner’s permit. When you buy one, it gets added to yours. It’s a pretty specific registration system that has been in place for decades.

 

The safe act is a clusterpuck but the requirement to renew handgun permits every 5 years is the least onerous change in its provisions.

 

It’s passage moved Central NY (sportsman’s paradise/God’s country) off my list of retirement options.

I read this working as designed. In less then a month most gun owners will loose their rights to own guns and be unable to get them back. Furthermore all those confiscated guns will be destroyed.

This is only true in a situation where the sheriffs choose to enforce the law. Most sheriffs in New York refuse to enforce the SAFE Act, and some are already hinting that they will refuse to confiscate guns from people with expired permits.

 

Now if youre in New York City, yes, youre in danger, but in the rest of the state? Likely not.

 

Again, an often-overlooked but vital key to defeating the gun control movement is non-enforcement. Sheriffs in New York and Connecticut are already doing just that, and I strongly suspect the same happened in Hawaii; that is, I strongly suspect that the state of Hawaii backed down from its call to disarm marijuana card holders when cops went to them and stated that they refused to participate. Having no one on hand to actually enforce the edict, the state backed down.
