5 Year Renewal

So, there is a lot of talk around here lately about Denials and appeals. Let me start by saying I did not have any issues getting approved. However, I feel for those that have had issues. While I was pondering the violations of their rights that have happened, I could not help but wonder.Will all these people that the get objected to but the CCLRB approves them or are denied but win an appeal, In 5 years, when they renew, will they have to go through this nightmare all over? Do renewals get a 30 day objection? just curious if those that must fight, will they have to fight every 5 years.

 

What I interpret, section 50 says that you do 3 hour training, re-apply, pay, and they redo section 35 (investigation) says nothing about section 15 (the 30 day objection) so it looks to me that law enforcement only get a chance to object to the initial application. after that they have no say.

 

What do you think?

 

 

This is the section that talks about the 30 day LEO objection.

Section 15. Objections by law enforcement agencies.

 

This is the section that describes the investigation. (background check, privacy invasion, etc)

Section 35. Investigation of the applicant.

 

This is the section that talks about renewal.

Section 50. License renewal.

Applications for renewal of a license shall be made to the Department. A license shall be renewed for a period of 5 years upon receipt of a completed renewal application, completion of 3 hours of training required under Section 75 of this Section,

payment of the applicable renewal fee, and completion of an investigation under Section 35 of this Act. The renewal application shall contain the information required in Section 30 of this Act, except that the applicant need not resubmit a full set of fingerprints.

Didn't some people get approved for a foid card and when they applied for the ccw license ended up getting denied the ccw license and also got their foid card revoked?

 

I'm assuming there was no new evidence. Just a more through investigation.

 

If I'm not mistaken didn't this type of "approval/revocation" happened to at least one member on this site?

If it did, I'd think the more thorough investigation turned up new evidence.

I was just saying that if a LEA (Dart) objected the first time to something and the board denied the permit. Then the applicant wins an appeal in circuit court. When it comes time to renew, If the 30 day objection period was repeated, I could see the LEA objecting again with the same info they used the first time.

 

I think it is moot due to I don't think a renew will subject you to the objection period again. But I was just curious if you guys interpreted the law the same way.

Jatwood brings up a good point. Lets say a person applies for renewal 30 days before his exiration date but the State takes 45 or 60 days. Is that person's license still good or is it expired?

© A license is invalid upon expiration of the license,
unless the licensee has submitted an application to renew the
license, and the applicant is otherwise eligible to possess a
license under this Act.
It looks to me like you would be good, although I'd hate to be the first guy to try explaining it to a cop.
