Challenge to Chicago's interpretation of its own AWB

Recommended Posts

Update:

Our first hearing is this Friday, at 10am.

My lawyer filed a motion to allow me to bring the rifles in to demonstrate their function, but this was pended. The judge will decide Friday whether he needs to see the rifles themselves.

If we do, I need to scare up some dummy rounds. All I've seen so far are 2-packs for $10-12. I'd prefer to have at least 10 to fill a stripper clip.

For my own use, I'd just reload sans powder and primer and drill holes through the cases to make it plain. But I'm not sure that'd be wise for demonstration in a Cook County courtroom.

do that and paint them yellow.

I'd rather have video of when you try to clear security in the morning and of corse someone will forget to inform the screening crew that you indeed have permission.

Yes, that you could sell tickets too. Maybe even a news flash from a nitwit reporter "Crazed gunman attempts to enter courthouse" , :headbang1: Film at 6:00.

Oh come on ... just use live rounds. I've loaded, chambered, and unloaded hundreds of live rounds without incident. And besides, you're sure to have a real live expert City of Chicago armorer on hand to ensure absolute safety.

What's the worst thing that could happen??

It went well. I liked the judge (Patrick T Rogers). He explained things well to those representing themselves, which was everybody but me), especially how the system is totally rigged against them.

My case was remanded back to the city 'court' for supplemental evidence, specifically the judge wrote an order allowing us to bring the rifles in go demonstrate their function. The city attorney agreed to this despite nearly sh!tting a brick. Our theory is they know they are going to lose and want to lose in their own 'court' rather than in County Court.

Off record the judge asked how I got interested in collecting guns and if I shot as well. He recounted how he likes shooting and that he once went down to Valpo and shot a spud gun and enjoyed it a lot.

Indeed. Good news, David, and I too thank you for taking the time and effort to fix one of the problems with Chicago's system.

Sadly I don't have a 'Harriet Tubman' anymore...

This is good theater! A gun demo in the court-room. This will make for good media. And why not!

P.S. Theater of the Absurd, eh ?

  • 3 weeks later...

Hide your kids, hide your wife!

Tomorrow SKS rifles legally get to have their day in [Kangaroo] Court. Literally! Not the Kangaroo part, even Kangaroos have more sense and fairness than Chicago's Administrative Hearings department.

Nope, by order of a Cook County Circuit Court judge, I'm bringing my four fixed-magazine SKS rifles downtown to explain their function and have Chicago's "expert" witness show me how you detach the mag and insert a fresh magazine without disassembling the rifle and purchasing after market parts.

If I see sirens and lights I'm just going to assume it's a police escort. :shtf:

Good luck, and let us know how it goes!

Edit: Actually i'm really curious to know how exactly they're going to make their case. Do you think the city will actually have somebody there who will try to demonstrate how to detach the mag? Or do you think it'll be a case where the city doesn't even bother to fight with anything other than procedural B.S.?

Or maybe they won't fight it at all? And you'll win by default?

This is going to be interesting in any event.

I think they'll put up a token fight, then quietly rule in my favor so that it doesn't go back to District court where their loss is more public.

So, shenanigans! Just found out, this morning, that despite arrangements being made over the past 2.5 weeks and even yesterday, CPD just realized that their "expert" witness is out on furlough. He is replacing the original "expert" who is out on injury leave, apparently having fallen out of his chair or something.
