Possible lawyer needed for SWB in Chicago

So I may need a lawyer, or may need to at least talk to one, regarding an AWB in Chicago confiscation. They told me to go to court and try to get them back, or if I move outside cook county I can have them. My question is, would I be able to transfer them to somebody outside Cook County, in a jurisdiction where they're allowed? If so, any attorneys with experience in this? What would it cost? If its more than $2,000, it'd be cheaper to just take the loss on them. Anybody with experience or that is an attorney, it'd be much appreciated.

WHY WOULD you let anybody in your HOME? Did they have a warrant? There's nothing wrong with Armslist if you use some common sense!

I tend to cooperate as opposed to escalate the situation. All my paperwork was in order, as always, so i didnt think itd be a big deal. They didnt have a warrant.

What dept where do you live?

It was Chicago police. Im on NW side of Chicago.

 

Who came to your door and what is the association with Armslist? Did they provide you paperwork for the weapons that were removed?

The Armslist association was an LC9 I sold on there previously, apparently the guy did something he shouldnt have so they were checking on paperwork and chain of ownership.

 

And it was Chicago police at the door. 4 of them. they said they'll provide paperwork when they get checked in either today or tomorrow

For their safety? Four of em? Tell them to stay it their car and wait till you bring out "the paperwork" BTW what "paperwork" would that be? Seems like the only thing you did wrong was to let them in your home with out a warrant and the accompany you to a bedroom GUNSAFE.

NEVER INVITE trouble no matter how innocent things might seem. I hope this serves as a lesson. I had a similar incedent happen to me, never again, and I did get my toys back. Had to go to Crook County court and get a writ of replevin.

The paperwork was the Bill Of Sale forms done for any sales. And how did you get the writ??? if its a similar situation, maybe I could do the same thing. I dont blame the officers, they were actually nice....they just did what they had to do based on the terrible Cook County stuff.

They will say all kinds of stuff to try and get inside or get you to consent to searches. The only thing you need to remember is that if there's no warrant, you don't have to consent to anything. If they force their way in and do it anyway then there's nothing you can really do except repeat that you don't consent to the warrantless search, but when it comes to court chances are it will get thrown out due to no warrant.

I would recommend having a separate safe for only paperwork. Also why did they grab both the guns and magazines since the guns themselves are not high capacity absent the magazines?

not sure. they actually unloaded the magazines and let me keep the ammo also.

 

Aside from allowing the police to see the guns that are a definite no no in your safe without them having any legitimate reason to even be in the home. This is why I have guns in my gun safe and paperwork in a filing cabinet.

thats the plan from now on. I never thought this situation would arise. they had asked to see a bill of sale once before but didn't accompany me upstairs like they did this time. For some reason there was double the amount of them this time also

They have a warrant? If not, you invited them in?

 

You let them view the contents of your safe?

 

Sounds like you made several wrong moves, hopefully better judgement from this point on.

Not sure if it'll make a difference, but they were originally looking for my late mother (the bill of sale they wanted was from a gun that was in her name, but when she fell ill she transferred to me, and i subsequently sold on armslist to cover medical bills she incurred)

I thought the registry was no more?
