TMarquis Posted December 17, 2017 at 11:56 PM Share Posted December 17, 2017 at 11:56 PM Hi, all! I am new to this board. Seems like a cool place to learn more about IL gun laws. Here is my situation: I applied for my CCL in August of this year. Had my FOID card since 2010; I just received notice that my FOID has been revoked for "mental health admission/over 5 years - 6/24/1994" In 1994 I was 18 years old, I am 41 now. Never ever been in trouble with the law... not even a ticket. In 1994 I took myself to a mental health facility due to horrific life occurences at that time. I was never medicated and was only there for 3 days, tops! I actually forgot about this up until the letter came. Will this be hard to appeal? My plan of action: Transfer my firearm tomorrow morning, turn in my FOID card to local police station, I will contact a licensed therapist for a mental health review, and then file the appeal. Is this the proper protocol? And also how long does something like this take to rectify? Thanking you all in advance! Molly B. Posted December 17, 2017 at 11:59 PM Share Posted December 17, 2017 at 11:59 PM Welcome to IllinoisCarry. You've come to the right place for info. Looks like you have the process well in hand. Do you have the links to the forms you need to submit? These types of appeals, unfortunately, seem to be taking about 6-9 months. sdf4 Posted December 18, 2017 at 05:31 AM Share Posted December 18, 2017 at 05:31 AM Ive never heard of this before. What would prompt the state to do this?
Xwing Posted December 18, 2017 at 02:45 PM Share Posted December 18, 2017 at 02:45 PM Ive never heard of this before. What would prompt the state to do this? Applying for CCL is what triggered it. This has unfortunately happened before to other people as well. When they do the check for the CCL, the officials find something which they "think" is disqualifying in the individual's past. Molly is going to hook up the OP with links to the forms. TMarquis,Thankfully there is a process where you can be vindicated and have your rights restored. Unfortunately it takes a long time and a bit of work. It is sad that it takes almost nothing for a government body to erroneously deny one's rights, and takes time & effort (and $$) to restore them. Good luck as you get this fixed! But you certainly have come to the right place for information!

In the past, after 5 years, a person was eligible for a FOID card. This changed in the past few years and now after 5 years you must have a mental health evaluation submitted to ISP before you are considered eligible. I believe the reason this popped up with your CCL application is that the ISP has spent the last 5 years updating their databases with info submitted to them by the mental health dept. years and years ago. An audit by the U.S. Justice Dept. found ISP was not in compliance and ordered them to update their databases. Now when folks apply for their CCL, these things pop up in the system. It's a hassle to go through the steps but you shouldn't have any trouble with the process. If you do not have a doctor or someone to do the mental health certification, you might consider your local mental health dept. You will fill out the first two forms and send to the ISP. We recommend sending special delivery requesting a signed receipt for delivery. The last form you will give to the person doing the mental health evaluation and they must send it in. https://ispfsb.com/Public/Firearms/FOID/AppealRequest.pdf(check the first box and list mental health treatment more than five years ago) https://ispfsb.com/Public/Firearms/FOID/Investigation.pdf https://ispfsb.com/Public/Firearms/FOID/MentalHealthCert.pdf

Glad I found this board. Thanks so much. Following the steps above! I have an appointment scheduled for mental health, my dr laughed at this and said "you wouldn't hurt a fly." Turned in my foid card to local police and they were scratching their heads at this reasoning. Transferred my weapon so now I am ready to put the work in. They will not take away my rights. Have a great holiday, all. Sent from my SM-G930P using Tapatalk
