In the House yesterday, HR140 Urge GA Explosive Law and HB2794 Crim Cd Explosives were tabled. Illinois Carry opposed both of these legislative actions because of their inclusion of reloading components in the proposed bans. Ours members can take pride in helping block their passage.

 

 

 

The House and Senate are both scheduled for 12:00 Noon today.

 

 

The Restorative Justice Committee hearing, which included HB167 Crim Cd Expunge Arrest, has beed cancelled.

HR14 Engelwood Viol Crime Tsk Force

Synopsis As Introduced

 

Creates the Englewood Violent Crime Task Force to: (1) study and determine the causes of violent crime in Englewood and nearby affected communities; (2) study and determine the feasibility of deploying the Illinois State Police to Englewood and nearby affected communities and neighborhoods; (3) develop a comprehensive long-term solution to the effect of violent crime in the Englewood and nearby affected communities; (4) recommend a plan of action to substantially reduce the incidents of violent crime in Englewood and nearby affected communities; and (5) draft any necessary legislation and make any necessary recommendations for appropriations to place the plan of action into immediate effect.

 

House Floor Amendment 2 - Pending

 

Replaces everything after the heading with similar language. Adds the Director of the State Police or his or her designee as a member to the Englewood Violent Crime Task Force. States that the Task Force shall review and analyze the Illinois State Police's headcount and minimum staffing levels in the Chicago area, calls for service, annual overtime cost, and other factors that would be relevant to a Illinois State Police presence in the Englewood community. States that the Task Force shall conduct a thorough review and analysis of the 2014 detail between Illinois State Police and the Chicago Police Department's fugitive apprehension unit in Chicago. Corrects the number of residents of the 32nd Representative District that have signed a petition for Illinois State Police assistance in their communities. Designates one of the 2 members of the Illinois House of Representatives chosen by the Minority Leader of the Illinois House of Representatives as a co-chair of the Task Force. Designates the Illinois State Police as the agency responsible for reimbursing the members of the Task Force. Adds the Mayor of the City of Chicago and the Mayor of the City of East St. Louis to the list of recipients of a copy of the resolution. Changes the date that the Task Force shall report its findings and recommendations and submit any and all proposed legislation to the Governor and General Assembly to on or before December 31, 2016.

HB169 Arrest Records Mistaken ID

Synopsis As Introduced

 

Amends the State Records Act and the Local Records Act. Provides that within 180 days after an investigation by a law enforcement agency reveals that a person has been arrested as a result of mistaken identity and no charges have been filed against the person, the law enforcement agency whose officers made the arrest shall destroy the arrest records of that person made as a result of mistaken identity. Provides that the law enforcement agency shall establish an access and review process for verifying that the person's arrest records relating to arrests because of mistaken identity in which no charges have been filed have been destroyed. Provides that the law enforcement agency shall provide by rule the process for access, review, and automatic destruction of these records. Defines "arrest records" and "law enforcement agency".

It's a national issue? I know it happens occasionally, but how many innocent people are gunned down because they presented a replica firearm in a threatening way to law enforcement that it's an issue worthy of federal law? And if such a law were passed, what happens when the bad guys figure out they can present what appears to be a replica firearm simply by painting a real firearm a bright color? Does anyone really think a bright colored firearm, real or otherwise is going to give law enforcement a reason to react any differently than it does already?

Your concern about criminals turning this to their advantage is one of the main arguments against such a bill, in addition to what tkroenlein mentioned.

 

This is exactly what is going to happen, some clever criminals are going to paint their firearms to look like the new "brightly colored toys" and by the time some unsuspecting cop or civilian crime victim realizes that it's not a fake gun, they are going to get killed. Then it will be the Gub'mint's fault, and the bill's sponsors and everyone who voted for it should be held legally responsible for passing such a potentially dangerous piece of legislation that only serves to make it easier for criminals to conceal that they have real firearms.
