Tvandermyde Posted September 13, 2013 at 10:02 PM Share Posted September 13, 2013 at 10:02 PM Guys, new motions were filed today in the cook county gun tax case. But since, I can't upload documents to the forum from my Ipad, you will have to wait just a bit longer, but you should get a kick out of the theory, and or pleading on the new motion for summary judgement. This week the judge denied the discovery/depositions of county personel, so I can't wait to see the look on their face when they read this.Think of the word regulation. . . .**** they won't upload ok I got the motion to load, but can't get the memo to load which has the REAL good stuff in it. I have forwarded them tot skinnny to post so hopefully they will get up soon. you should all get a giggle out of them . I think a judge and the county are going to be . . . wait for it . . . . Talonap Posted September 14, 2013 at 01:50 AM Share Posted September 14, 2013 at 01:50 AM This would only cover handguns, correct? (If our side wins.)
AJR Posted September 14, 2013 at 02:11 AM Share Posted September 14, 2013 at 02:11 AM I think I will send the County my bill now, so they will know where to send my check/s.As much as I hated the tax, I didn't hold that extra amount against the local gunshops when price shopping and they did get my business. defaultdotxbe Posted September 14, 2013 at 02:19 AM Share Posted September 14, 2013 at 02:19 AM This would only cover handguns, correct? (If our side wins.)Possibly. However if the whole law gets struck down the preemption would prevent them from enacting a new one for long guns only. It could also go like the CFP, Chicago dropped it for all guns, not just handguns

Mr. Fife Posted September 14, 2013 at 02:58 AM Share Posted September 14, 2013 at 02:58 AM I learned a new term, "Motion to Quash". OK, next mission Todd. I want to take my new, new to me, carry right in Illinois and carry in the Cook County Forest Preserves and Chicago city Parks. I don't really care how long it takes as long as its a done deal for the New Year. Thanks for everything you do!

2putt Posted September 14, 2013 at 03:58 AM Share Posted September 14, 2013 at 03:58 AM Does this mean we will get refunds for the taxes we paid when buying a gun? Just bought my Glock a couple weeks ago at Maxons.

AJR Posted September 14, 2013 at 04:41 AM Share Posted September 14, 2013 at 04:41 AM The way I read it, it was unconstitutional from the start, so it may go back to the beginning. One case just links to another in such harmony.

Oh I didn't pull these, Todd asked me to post the memorandum so thank Todd for the laughs The exhibits are just icing. The thing is that they keep calling the tax a regulation. Well, if everyone recalls, the FCCA preempts anything Crook County vomits out or any other home rule unit with regard to preemption. That's the gist of this motion for summary judgment. Nothing more enjoyable than using Crook County's own words against it hahaha.
44Brent Posted September 14, 2013 at 10:00 PM Share Posted September 14, 2013 at 10:00 PM Lawyers by their nature try to create tangled webs of words with which to entrap their victims. In this case they entangled themselves. It pleases me greatly to see them get entangled in their own nets.
