337 and 3256 sent to the Governor?

I thought these were being sat on because of the motion to reconsider. Anyone know what's going on?

Last Thursday the Illinois state Senate voted to concur Senate Bill 337, which would establish a firearm registry and shut down your local gun stores with onerous red tape and regulations, as well as Senate Bill 3256, which would expand the 72 hour waiting period to all firearms. These two bills will now head to Governor Bruce Rauners desk, where they will join House Bill 2354, which would allow Second Amendment rights to be revoked without due process. Please contact Governor Rauner and urge him to VETO SB 337, SB 3256, and HB 2354. Click the Take Action button below and call 217-782-0244 to contact Governor Rauner.

 

 

Senate Bill 337, as amended by Representative Kathleen Willis (D-77), was concurred by the Senate with a vote of 35-20. It would direct the state police to create an electronic transaction form for firearm transfers, which would amount to a registry.

 

Senate Bill 3256, as amended by Representative Jonathan Carroll (D-57), was concurred by the Senate with a vote of 40-10. It would also expand the 72 hour waiting period to all firearms.

 

House Bill 2354, sponsored by Rep. Kathleen Willis (D-77), was passed by the Senate with a vote of 43-11. It would allow for the issuance of protective orders to infringe on Second Amendment rights based on third party allegations with little, if any, real evidence and limited due process for the respondent. Hearings for the orders would be ex parte, where the respondent is not present to challenge the accuser and defend against allegations made against them.

 

Further, for truly dangerous individuals, this bill does nothing to incapacitate the subjects of the orders, as there is no requirement that they receive mental health treatment. Again, please click the Take Action button above and call 217-782-0244 to urge Governor Rauner to VETO SB 337, SB 3256, and HB 2354.

(I'm not aware of any clocks on time between "Passed Both Houses" and "Sent to the Governor".

 

and doing so starts the Governor's 60 day clock.

the 15 day veto clocks won't start until that chamber

(SB's go back to the Senate FIRST, HB's go back to the House FIIRST) is called to order.

(I'm not aware of any clocks on time between "Passed Both Houses" and "Sent to the Governor".

I thought there was a 30 day window to send but I could certainly be wrong. And being recessed may have additional impacts.

Senate Bill 337 is simply a policy bill - it does nothing to jeopardize any of our second amendment rights, which I have strongly supported and will continue to support.

 

All Senate Bill 337 does is reduce illegally trafficked guns from entering our communities. I am in favor of any bill that will keep people safe from gun violence by making sure guns do not end up in the hands of the wrong people.

 

This is not a Republican issue, it is not a Democrat issue, this is a people issue.

You should educate the doofus. Educate him that the registration of private sales is a direct infringement, that potentially leads to worse. Then educate him, that the rest is tailor made to shut down gun stores. it's admitted real purpose, stated in committee. AS SUCH, if there is no where to buy a gun, that is effectively the same thing as banning all guns, AKA INFRINGEMENT. .

Due to ILGA political shenanigans, Ive seen bills sent to the gov office the next day and other times near the end of the 30 days. Not sure of various nuances e.g. if ILGA is out of session.

A motion to reconsider can stay in effect as long as the legislative session lasts. When the next legislature is seated, all motions expire.

 

I haven't read the state constitution on this point, but the better question is how late the legislature can pass a bill. I suspect it's required to allow the governor enough time to veto it.

edit - for SB337 / email status read the next post I did... The status of SB337 remains unchanged - on hold / pause indefinitely this session because of the "motion to reconsider".

 

The bill SB337 can have it's "motion to reconsider" lifted at the start of the "veto session" which is AFTER the November 6 general election - which is dangerous because lame duck losers can have their revenge without consequence.

 

 

The Senate stands adjourned until 11/13/2018 @ 12:00 Noon.
The House stands adjourned until 11/13/2018 @ 12:00 Noon.

 

 

SB337 stays live under it's "motion to reconsider" until the NEXT Session (we're in the 100th session now, and the NEW 2 year session (101st) which starts January 9, 2019 cleans the slate of all bills and starts fresh.

 

I see what you mean about the Governor's 60 Days on a Bill.

 

 

Inauguration takes place on the second Monday in January following a gubernatorial election.

 

The Governor's inauguration for the 2019 - 2023 term is January 14, 2019

and subtracting 60 days from that gives November 15, 2018

 

The election is on November 6, 2018;

 

 

Then if vetoed, there are 15 days for the issuing body to override, and an additional 15 days for the other chamber to override.

 

 

Article IV of the Illinois Constitution establishes when the General Assembly is to be in session. Section 5 of Article IV states that the General Assembly will convene its regular session on the second Wednesday of January.

That is January 9, 2019.

 

So the bill dies BEFORE and the 101st session of the General Assembly starts before the next Governor is Inaugurated.

 

So, send it to the Governor too late and SB337 can become an interesting legal conundrum.

Just got an email from NRA-ILA calling for action now on 337, SB 3256, and HB 2354. Stating the bills went to the Governor's desk. Did this happen or a oops?

I just got one too, and it's (SB337 "to the governor") what started me on the last post.

 

It's a possible "oops", but I can see why they included it. The "motion to reconsider" holding SB337 can be withdrawn at ANY TIME.

July 16, 2018 Governer Bruce Rauner signed into law SB3256 and HB2454.

 

Look to an earlier post above for details.

 

Effective date for both is January 1, 2019.

 

The statuses of the other bills in this thread are unchanged.
