The bill makes it a crime to:

 

> record a conversation to which you are not a party

 

> surreptitiously record a conversation to which you are a party

 

> record electronic communication (eg email) to which you are not a party

 

It also extends to 1/1/2018 the law enforcement exemption and includes more crimes eligible under the exemption, and requires an annual report of how often this is used.

In response to Rep Thapedi, Rep Nekritz states that the legislative intent is not to allow prosecution such as was done in People v Annabell Melongo.

 

Legislative intent is further defined as applying to private conversations, and that government employees talking as part of their job is not considered private.

 

Ms. Nekritz also notes that there is a severability clause, in the event sections of this bill/law would be struck down.

mauser - what is your take on it as it pertains to normal folks recording their interactions with police be it in a vehicle or walking down the street?

 

I haven't had a chance to read it in depth. The legislative intent seems to be that it would not apply to those interactions, but it was recognized in debate that some of the language in imperfect.

FURTHER RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-EIGHTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE SENATE CONCURRING HEREIN, that when the House of Representatives adjourns SINE DIE on Wednesday, December 03, 2014, and when the Senate adjourns on Thursday, December 04, 2014 pursuant to this joint resolution, both the House of Representatives and Senate stand adjourned SINE DIE with respect to the First Special Session of the 98th General Assembly.
