Senate Amendment 4 to HB3469 is being debated in the Senate. In part, it allows ISP to decide to unilaterally extend to more than 30 days the issuance of FOID cards. The sponsor indicates it was negotiated with ISRA.

 

Senator Righter indicates that it was not negotiated with the R side of the aisle and, if it had been brought to them, they would have objected.

House Amendment 4 has been filed on SB1621 and referred to the Executive Committee:

 

Replaces everything after the enacting clause. Amends the Secretary of State Act. Modifies provisions concerning emergency powers to further allow the Secretary of State to adopt emergency rules concerning the expiration dates of driver's licenses, driving permits, monitoring device driving permits, restricted driving permits, identification cards, disabled parking placards and decals, and vehicle registrations. Removes provisions requiring the Governor to issue a statewide disaster proclamation in order for the Secretary of State to exercise specified powers. Repeals provisions on January 1, 2022. Amends the Department of Commerce and Economic Opportunity Law of the Civil Administrative Code of Illinois. Makes changes concerning financial support to units of local government under the Local Coronavirus Urgent Remediation Emergency (or Local CURE) Support Program. Provides for the reenactment of a Section creating the Restore Illinois Collaborative Commission. Extends the repeal date from December 31, 2020 to January 1, 2022. Amends the General Assembly Organization Act and the Legislative Commission Reorganization Act of 1984. Provides that in cases of pestilence or public danger, such that in-person participation poses a significant risk to the health or safety of members, staff, or the public-at-large, members of the General Assembly and Board members may participate remotely and cast votes. Amends the Property Tax Code. In provisions concerning the homestead exemption for persons with disabilities, the homestead exemption for veterans with disabilities, and the senior citizens assessment freeze homestead exemption, provides that those exemptions may be granted without application for the 2021 taxable year if the property qualified for the exemption in the 2019 taxable year, subject to certain limitations related to the COVID-19 pandemic. Amends the Firearm Owners Identification Card Act. Provides that upon a disaster declaration or other specified circumstances, the Illinois State Police may by rule or emergency rulemaking extend the expiration dates of Firearm Owner's Identification Cards. Makes other changes concerning the validity of Firearm Owner's Identification Cards. Amends the Firearm Concealed Carry Act. Provides that upon a disaster declaration or other specified circumstances, the Illinois State Police may by rule or emergency rulemaking extend the expiration dates of concealed carry licenses. Amends the Open Space Lands Acquisition and Development Act. Provides that for any grant made to a unit of local government, a minimum of 50% of the grant must be paid to the unit of local government at the time of the award of the grant. Allows a unit of local government to opt out of the advanced payment option at the time of the award of the grant. Provides that the Department of Natural Resources shall consider an applicant's request for an extension to a grant if (i) the advanced payment is expended or legally obligated within the 2 years as required by the Illinois Grant Funds Recovery Act or (ii) no advanced payment was made. Amends the Child Labor Law to provide that a person authorized to issue employment certificates to minors may determine that a minor may utilize a remote application process. Provides that a minor shall be accompanied by his or her parent, guardian, or custodian, whether applying in person or remotely. Removes certain provisions allowing the City or County Superintendent of Schools to waive the in-person application requirement if a minor resides in another state. Amends the Illinois Administrative Procedure Act to provide for emergency rulemaking. Makes conforming changes. Effective immediately.

HB1586 Crim Cd - Handgun Ammo - Serialize

Synopsis As Introduced

Amends the Criminal Code of 2012. Provides that beginning January 1, 2020, all handgun ammunition that is manufactured, imported into the State for sale or personal use, kept for sale, offered or exposed for sale, sold, given, lent, or possessed shall be serialized. Provides that beginning January 1, 2020, any person who manufactures, causes to be manufactured, imports into the State for sale or personal use, keeps for sale, offers or exposes for sale, or who gives or lends any handgun ammunition that is not serialized is guilty of a Class A misdemeanor. Provides that beginning January 1, 2020, any person who possesses in any public place any handgun ammunition that is not serialized is guilty of a Class C misdemeanor. Provides exceptions. Provides that beginning January 1, 2020, the Department of State Police shall maintain a centralized registry of all reports of handgun ammunition transactions reported to the Department in a manner prescribed by the Department. Provides that information in the registry, upon proper application for that information, shall be furnished to peace officers and authorized employees of the Department of State Police or to the person listed in the registry as the owner of the particular handgun ammunition. Provides that the Department of State Police shall adopt rules relating to the assessment and collection of end-user fees in an amount not to exceed $0.005 per round of handgun ammunition or per bullet, in which the accumulated fee amount may not exceed the cost to pay for the infrastructure, implementation, operational, enforcement, and future development costs of these provisions. Effective January 1, 2020, except some provisions effective immediately.

Provides that if an officer of a law enforcement agency initiates an investigative stop, including but not limited to a traffic stop, of a licensee or a non-resident carrying a concealed firearm, the licensee or non-resident shall disclose to the officer that he or she is in possession of a concealed firearm under the Act and present his or her concealed carry license to the officer if he or she is a licensee or present to the officer evidence that he or she is a non-resident qualified to carry under the Act (rather than providing this information upon the request of the officer). Provides that the licensee or non-resident shall also identify the location of the concealed firearm (rather than providing this information upon request of the officer).

Senate Amendment 5 was filed on HB3469 earlier this morning:

 

Removes a provision allowing the Illinois State Police to by rule or emergency rulemaking extend the expiration dates of Firearm Owner's Identification Cards and concealed carry licenses if the Illinois State Police are unable to approve or deny renewal applications within 60 days after specified time-lines.

 

It was adopted and the bill was passed out of the Senate back to the House for concurrence on several amendments.
