Nicholas Ennis says hes been driving around for about a year with the sticker displayed, but it wasnt until recently that he was told the sticker is obscene. According to the Sumner County Sheriffs Office, the sticker falls under a Tennessee law prohibiting obscene obscene or patently offensive bumper stickers, window signs, etc. The sticker in question, which features two rifles and the letters u and c above the phrase gun control, is a no-no because of the expletive spelled out with the firearms and the letters, or so says the sheriff. UCLA law professor Eugene Volokh, on the other hand, says its the citation thats problematic, and says the attempt to police Enniss sticker is clearly unconstitutional. Who determines what is obscene, offensive. WHom is that arbiter? This law is the one that scares me. NY is blatantly ripping up the 1st amendment, and fining people up to $250,000 for "daring" to upset someone by calling them an illegal alien. I really hope someone sues and gets punitive damages against NY. Once a law like this is allowed to stand, we might as well give up even pretending to have a Bill of Rights.
