FED. JUDGE ISSUES PRELIMINARY INJUNCTION AGAINST CALIFORNIA GUN SHOW BAN


A federal district court judge in California has issued a preliminary injunction against the Del Mar Fair Boards attempt to ban gun shows, in a case involving the Second Amendment Foundation, other groups and individuals.

SAF is joined by the California Rifle and Pistol Association, B&L Productions, Inc., Crossroads of the West, South Bay Rod and Gun Club, Maximum Wholesale/Ammo Brothers and five private citizens. SAF is represented by veteran attorney Donald Kilmer, who has won previous lawsuits challenging gun show restrictions in the Golden State. CRPA is represented by attorney Chuck Michel, another veteran of gun law litigation. The case is supported by the National Rifle Associations Institute for Legislative Action.

Federal District Judge Cathy Bencivengo issued the preliminary injunction, prohibiting the Del Mar Fair Board from enforcing a recently-enacted moratorium on gun shows at the fairgrounds. Plaintiffs in the case consider this a huge victory over a moratorium that took effect back on Jan. 1 and the lawsuit was followed later that month.

Of course were delighted with this ruling, said SAF founder and Executive Vice President Alan M. Gottlieb. At a time, and in a state, where law-abiding gun owners seem under constant attack, having a federal judge side with our complaint validates our efforts to protect constitutional and civil rights.

Lately, he added, it seems like a week doesnt go by without another court victory in our efforts to win firearms freedom one lawsuit at a time.

The lawsuit was filed in U.S, District Court for the Southern District of California in San Diego. At the time, Gottlieb called the fairground boards action as an attempt to marginalize gun owners and exclude them from the public square. He suspects this is an effort to drive gun shows from public venues altogether.

California: CRPA and NRA Victory! Federal Court Issues Preliminary Injunction Against Del Mars Attempt to Ban Gun Shows

On Monday, June 17, the California Rifle and Pistol Association attorneys with the support of NRA and others, secured a major victory in the fight against Del Mars attempt from banning gun shows. Following oral arguments, federal district court judge Cathy Bencivengo issued an order granting Plaintiffs request for a preliminary injunction, thereby prohibiting the Del Mar Fair Board from enforcing its recently enacted moratorium to stop gun shows which took effect January 1st of this year.

Although the judge declined to issue a decision on the merits at this time, the preliminary injunction means that gun show promoters may now request dates and hold shows while the case continues.

This is a huge first victory for those involved in the case including CRPA, NRA, Second Amendment Foundation, South Bay Rod and Gun Club and all of the individual plaintiffs.

The 22nd District Agricultural Association (22nd DAA) manages and operates the Del Mar Fairgrounds; its nearby equestrian facility, the Horsepark; and the Del Mar Golf Center, on behalf of the State of California. No tax monies are used in the operation of these facilities. The Del Mar Fairgrounds supports its budget through admission, parking and facility rental fees. The Fairgrounds, including its parking lots, is approximately 340 acres; Horsepark is approximately 65 acres.


It sounds like the fairgrounds is private property. Hmm, DuPage County Fairgrounds?

It says they manage and operate on behalf of the State of California, that leads me to believe that it's public property, but privately managed.

Gottlieb says a lot of things which aren't true.  Last time I checked, his Second Amendment Foundation website still listed Richards v. Prieto as a victory (he lost en banc, 7-4).

 

But feel free to list these "weekly" victories.


Concealed carry is of no use to me because I don't carry a purse or wear a dress, and I'm not into secret advantage and unmanly assassination.

I wouldn't be too happy or upset with any district court opinion, it always gets appealed.
