Last Friday in the legislature, HB5922 Criminal Law Tech (Trespass) and HB4329 Hunting & Fishing License Fees passed the House as amended. Both are pending consideration in the Senate, though we are actively monitoring only the former.




The House and Senate are scheduled for 12:00 Noon..

HB4754 Crim Cd 3D Firearms Prohibits

Synopsis As Introduced

Amends the Criminal Code of 2012. Creates the offense of unlawful use of a three-dimensional printer to create a firearm. Provides that a person commits the offense when he or she uses a three-dimensional printer to create a firearm, or any piece or part of a firearm, unless the person possesses a license to manufacture firearms under the federal Gun Control Act of 1968. Provides that a violation is a Class A misdemeanor.

House Committee Amendment No. 1

Exempts from a violation, a person actually engaged in the business of manufacturing and selling any piece or part of a firearm to a person who possesses a license to manufacture firearms under the federal Gun Control Act of 1968, but only with respect to the activities which are within the lawful scope of that business.

House Floor Amendment No. 2 - Pending

Replaces everything after the enacting clause. Amends the Criminal Code of 2012. Reinserts the provisions of the bill, except adds exemption for a person who uses a three-dimensional printer to create a non-functioning prototype of a firearm. Requires that the person must knowingly use a three-dimensional printer to create a fully functioning firearm. Retains exemption for a person who possesses a license to manufacture firearms under the federal Gun Control Act of 1968. Deletes the amendatory changes made by House Amendment 1 and that the offense applies to creating a part of a firearm.


House Floor Amendment No. 3 - Lost in Committee 4/3/2014

Replaces everything after the enacting clause. Amends the Criminal Code of 2012. Reinserts the provisions of the bill, as amended, except provides that a three-dimensional printer is a computer (rather than a computer-driven machine). Adds exemption for a person who uses a three-dimensional printer to create a prototype of a firearm. Requires that the person must knowingly use a three-dimensional printer to create a fully functioning firearm. Retains exemption for a person who possesses a license to manufacture firearms under the federal Gun Control Act of 1968. Deletes provision that the person is actually engaged in the business of manufacturing and selling any piece or part of a firearm must sell it to a person who possesses a license to manufacture firearms under the federal Gun Control Act of 1968. Adds definition of "prototype".





HB5523 Criminal Cd Seizure Vehicles

Adds various offenses to the list for which a vessel, vehicle, or aircraft used with the knowledge and consent of the owner in the commission of, or in the attempt to commit, the offense may be seized and forfeited. Provides that the vessel, vehicle, or aircraft may be seized and impounded by law enforcement agency (rather than delivered forthwith to the sheriff at the Courts of Seizure). Effective immediately.

Provides that the unlawful use of weapons provisions prohibiting with certain exceptions a person from carrying or possessing a pistol, revolver, stun gun, or taser or other firearm in any vehicle or concealed on or about his or her person or upon any public street, alley, or other public lands within the corporate limits of a city, village, or incorporated town and the aggravated unlawful use of a weapon statute do not apply to or affect a currently employed tactical paramedic while in the performance of his or her official duties. Defines "tactical paramedic".

SB3538 Crim Cd Trespass State Support

Synopsis As Introduced

Amends the Criminal Code of 2012. Provides that a person also commits criminal trespass to State supported land when he or she enters upon land owned, leased, or otherwise used by a public body or district organized under the Metropolitan Transit Authority Act, the Local Mass Transit District Act, or the Regional Transportation Authority Act, after receiving, prior to the entry, notice from the public body or district, or its representative, that the entry is forbidden, or remains upon the land or in the building after receiving notice from the public body or district, or its representative, to depart and, in doing so, causes a delay in transit service lasting more than 15 minutes or compromising public safety. Provides that a first violation is a Class 4 felony and a second or subsequent violation is a Class 3 felony.
