Anti-gun Control sticker on car leads to ticket

A Tennessee man says hes going to fight a citation recently issued by a Sumner County sheriffs deputy over an anti-gun control sticker on his truck. Nicholas Ennis says hes been driving around for about a year with the sticker displayed, but it wasnt until recently that he was told the sticker is obscene.

 

According to the Sumner County Sheriffs Office, the sticker falls under a Tennessee law prohibiting obscene obscene or patently offensive bumper stickers, window signs, etc. The sticker in question, which features two rifles and the letters u and c above the phrase gun control, is a no-no because of the expletive spelled out with the firearms and the letters, or so says the sheriff.

 

 

UCLA law professor Eugene Volokh, on the other hand, says its the citation thats problematic, and says the attempt to police Enniss sticker is clearly unconstitutional.

Seems to be the new liberal trend, as if attacking the 2nd isn't bad enough they are not attacking the 1st with no shame.

 

NY just outlawed the words "illegal alien" if it's used in a negative context, I HOPE that the courts slap NY in the face for the law but sadly I expect the liberal lower courts to play along with censorship.

It would appear the liberal interpretation of the 1st means it only applies to speech that matches their ideals, just like they insist the 2nd only applies to the military and certain arms.

I think I'm not understanding something. How is the letters "U" and "C" above the word "Gun Control" offensive?

It's blurred out in the picture, so I'm assuming the letters are drawn on top of a pair of butt cheeks or boobs or something else someone might find offensive.

Am I wrong?

So, it's a similar case with guy who got arrested for an "I eat a**" sticker on his truck.

 

When I was in college my cousin (not distant enough) has a sticker on the back of her car.

If you can beat me you can eat me.

She had a Chevelle and I had a Goat would have been a good run...

I sincerely doubt the cop who gave him the citation was "the left" or a liberal.

 

Let's just be honest there.

 

Plenty of folks on the right willing to engage in censorship, just like there are many folks on the right who are Gun-control Antis.

So, it's a similar case with guy who got arrested for an "I eat a**" sticker on his truck.

It’s an illegal law that violates 1st amendment rights. Period. It will be thrown out in a heartbeat.

 

How about something a little less ignorant like "No Gun Control !"?

How about not picking and choosing which rights you want upheld? The 1st amendment invalidates the law and the citation.

Yes, the Citation would applt, as the original law would. HOWEVER, that law SHOULD be deemed Unconstitutional and an infringement of the 1st Amendment. Who determines what is obscene, offensive. WHom is that arbiter? THis is WHY we have a 1st Amendment, because tyranny lies on the path where we let the Government determine what is offensive or obscene.

There's another similar case working it's way through the system from a man that had a sticker on the back glass of his pickup truck that read "I EAT A**"

 

Charges were dropped within days of him being arrested, albeit last I heard he was considering suing the police for violating his rights.

This law is the one that scares me. NY is blatantly ripping up the 1st amendment, and fining people up to $250,000 for "daring" to upset someone by calling them an illegal alien. I really hope someone sues and gets punitive damages against NY. Once a law like this is allowed to stand, we might as well give up even pretending to have a Bill of Rights.
