Gun licensing bill fails, supporters vow to bring it back

A major gun licensing reform bill will not make it out of the Illinois legislature this session.

 

Backers of the Fix the FOID act, which was largely a response to a mass shooting in Aurora in February, have vowed to bring back the measure for another try.

 

Proponents say the bill is needed to strengthen background checks for gun owners and provide more funding to better enforce existing laws that bar dangerous people from possessing weapons.

 

The measure, which would have increased fees for gun licenses and required all applicants be fingerprinted, won House approval earlier this week despite opposition from lawmakers who said it infringed on Second Amendment rights. But legislators told the Tribune on Friday that the bill would not be called for a vote in the Illinois Senate.

 

The failure of the bill that was prompted by one mass shooting happened to occur on the day of another mass shooting, this one in Virginia Beach, Va., where local authorities said 11 people were killed Friday.

 

The February mass shooting in Aurora by a revoked Illinois license holder who should never have been able to purchase the handgun he used to kill five people became a rallying cry for supporters who wanted to close loopholes in the law.

 

But the legislation faced strong opposition, with detractors calling the proposed new regulations among the most onerous in the nation and an infringement on their constitutional rights.

 

The bill was debated for three hours in the House, with Downstate and suburban Republican lawmakers challenging the need to fingerprint or raise fees on lawful gun owners.

 

On Friday, Democrat Julie Morrison, the Senate sponsor of the bill, spoke strongly in support of it but said she ran out of time to explain to fellow senators the significant changes it proposed.

 

I feel confident that it is going to become law, Morrison said. Its just not going to become law May 31.

 

Kathleen Sances, president of the Gun Violence Prevention PAC, which was involved in drafting the legislation, is holding out hope the proposal will come for a vote before the Senate at a later date.

 

Were really thrilled that we were able to get the bill out of the House, and I really have to give credit to Rep. (Kathleen) Willis, Sances said of the bills House sponsor. We ran out of time in the Senate. So moving forward well just be talking with both chambers and well see what we can do to get enough votes to pass it in the Senate.

 

Morrison said the legislation could be taken up in November during the veto session.

 

The call to require fingerprinting to obtain a state firearms license, known commonly as a FOID, gained serious steam after Aurora gunman Gary Martin opened fire with a Smith & Wesson handgun at the Henry Pratt Co. and killed five co-workers. Martin, a convicted felon, was prohibited from owning a gun and had his FOID card revoked by Illinois State Police in 2014. But he managed to keep both the license and the Smith & Wesson he used in the mass shooting.

 

Willis, the House sponsor, vowed to continue the fight to pass the legislation.

 

While I am disappointed I remain committed to continue to work over the summer with the stakeholders to return with a bill that will address the issues with the (FOID) system and make our state safer, Willis, a Democrat, said in a statement to the Tribune.

 

Besides the fingerprinting provision, the measure would have increased the application fee from $10 for a 10-year FOID card to $20 for five years. Some of the additional revenue would have funded a task force to account for the firearms of revoked cardholders.

 

The Illinois State Police, in the wake of Aurora, instituted major changes to how FOID card revocation details are shared among law enforcement, taking the unprecedented step of creating a database listing every revoked cardholder statewide.

 

The information, which has been shared with most departments, includes the crucial information about firearms purchasing history for each revoked cardholder and the reason for the revocation. State police also announced they planned to form regional task forces to help communities address their backlogs.

 

But all of this now appears to be happening without any additional money that the legislation would have provided through the fee increase.

 

Long-term, more funding is critical to addressing the revocations and the backlog, but in the meantime the work needs to continue, said Cara Smith, chief policy officer for the Cook County sheriffs office, which has a revocation team. Dangerous people are revoked every day.

The ISP already had a database of all FOIDs. Does somebody think the ISP throws away FOID-holder information the moment the card is printed? Or the moment it expires?

 

There was another article that explained how the ISP enforced revoked/suspended/expired FOIDs. First, they assume individuals voluntarily comply with the law. Then if someone tries to use an invalid FOID, the ISP gets a search warrant.

 

Welcome to western democracy. That's how the law is supposed to work. Cops should not act automatically on the suspicion that every individual is committing crimes. There actually has to be a crime first.

The antiquated, useless, will-not-prevent murder FOID system ought to be abolished. None of the killers this weekend in Chicago or the rest of Illinois had a FOID card. And if anyone of them had such a card, that did not stop the killer from killing. By the way, there are a lot of good, non-violent gun owners who do not have a FOID card. They may not have applied for one,or the card may have expired. Yet, Aunt Susie, who never had a FOID card, is not riding around with her "piece" hunting for victims. But don't attack her at the bus stop or invade her house. She will shoot you "grave yard dead."

Firearms are not the problem. If they were, then all police officers, armed security guards, private detectives, CCW licensees, hunters, and armed fishermen -all of whom are armed- ought to be disarmed. Because, if guns are the problem, these people should get rid of their guns. The violent crime rate would dramatically drop. One problem. These people are not responsible for the violence. Go after Thug, who is the source of the violence. Ponder that.....

Someone in the House and Senate need to get together and produce a mirrored set of bills named "Correct the FOID".

 

Fix any deficiencies in the current system, permanently set the cost to $5.00 for 10 years, with the money going exclusively towards funding "Eddie Eagle" in all grade schools (you know, gun safety for children, and all that), and making it illegal for future legislatures to tamper with it.

 

Have it set and ready to file the first day of session.....

OK, I admit to being jaded, from living in Illinois for too long.

 

But ... IMHO, the only reason they didn't get the "Fix the FOID" crapola passed, is because; 1. They had bigger fish to fry and 2. They are lazy slobs.

 

The Budget, Recreational Marijuana, Expanded Gambling/Chicago Casino and expanded Abortion bills were all higher profile and will result in much higher revenue streams (in their pockets) for these gangsters.

 

We also benefited from the sheer ingrained laziness of these slobs. They sit around for months, scratching their rears, naming playgrounds after themselves and passing honorary resolutions for this and that. Then in the last week, they get all heated up and push through the absolute most important bills, the ones that bring money to their coffers.

 

Our best shot? Get the whole FOID thing tossed by the courts, before they get back in session. No other state has it and no one needs it. Just one more thing these weasels can hold over our heads.

This makes me wonder

Why would Willis "return with a bill that will address the issues with the (FOID) system." Assuming she really believes this one will, the only reason to create a new one, is because she doesn't see this one passing.

 

Then again, alternative is she darn well knows this doesn't 'fix the foid'

There are those of us who live on a low monthly income due to our health. It is very expensive to move any distance. If there were a way to do it , I would already be gone. It is not a choice for some of us.

 

I will not surrender , I will continue to fight , and I will also continue to try and find a way to get out of this state.

 

ETA : I am happy for the ones who have been able to get out of this state. It is the smart thing to do.

My wife has always been reluctant to move, and there is no real reason other than inertia.

 

I believe when this pond scum gets around to taxing retirement benefits, and or course exempting their own salaries, that might get her attention.

 

If it was just up to me, I would have left in mid-2014 when I retired. You can only push that stone up the hill for so long, before the stone beats you.

 

This last election may be that time. I will continue the fight, for as long as I can't convince her to get off of this sinking garbage scow.

There is a possibility that over the summer she might lose her footing and drown in her trough. She could choke to death on hog chow. It's in the realm of possibility. The accurate biometrics lobbiests were all over this. They're former Tom Dart and other Illinois gov agency stoolies so they knew exactly how much constitutional law they could violate and get away with.

With Accurate Biometrics taking a position of supporting the bill (correct me if wrong), I would never use them or recommend them to anyone.

It is and allowed under a regulartory rules of the Brady Bill by states with their own system.

Nobody really got into the casual racism being pushed out by these white suburban women. Few things are more discriminatory against people that have already been subjected to poverty due to institutional racism than having to pay to prove they have a right.

Only 8% of Americans believe third trimester abortions should be legal. Enough said. The problem is that we, as a populace, are apathetic pieces of garbage who have become too dependent on the government and technology. We don't look outside of our own personal bubble. There's a guy in Alabama, on death row I believe, who challenged his double murder conviction for killing a pregnant woman and her unborn child. Specifically the conviction for murdering the child, or as people like Pritzker would say, "clump of cells" (with eyes, fingerprints, a heartbeat....). He asked a simple question - why can he be convicted of murder for killing the kid if she can trot into an abortion clinic and "take care of it" and it's a "right." Alabama Supreme Court went and said "Well, under PP v. Casey, an abortion is health care." Affirmed the conviction. Don't recall if the dissent, concurrence, or majority stated this is a HUGE problem with Roe v. Wade. An unequal application of the law.
