SCOTUS Relists all 10 2A cases

A number of Second Amendment cases 10 in all have been in suspended animation for months. Cases involving everything from may issue to banning assault weapons to interstate sales have been at the Supreme Court for consideration some for years and have been punted along, most likely awaiting a resolution in the New York State Rifle & Pistol Association v. City of New York case.

With all this talk about "fear" lately, I'm wondering if the fear-peddling is the only thing that the Donald has going for him.

He certainly doesn't have a solid 2A track record.

Further down it states

 

"This morning, the Court’s order list was released…and didn’t mention any of the cases. The Justices have relisted all 10 of the Second Amendment cases, meaning the Court can take them up at some time down the road."

 

I read that as they can take them up in the future, what did I miss?

That it won’t be immediate like some suspected

I think that Roberts is trying to keep the court's image as if it were just barely right of center. He knows the outcome of decisions that haven't been released yet and I suspect that if there is a big conservative win, he will temper it with minor liberal victories. Once the dust settles from this year's decisions he will let next year take form.

SCOTUS has ten 2A cases to sort through. Not surprised they want more time to go over them before making a decision on which one(s) they want to grant cert.

 

Relist is not a bad thing.

Question: What does it mean for the Court to relist a case?

 

Answer: When a case is “relisted,” that means that it is set for reconsideration at the Justices’ next Conference. Unlike a hold, this will show up on the case’s electronic docket. A relist can mean several things, including the fairly straightforward prospect that one or more Justices wants to take a closer look at the case; that one or more Justices is trying to pick up enough votes to grant review (four are needed); that the Justices are writing a summary reversal (that is, a decision that the lower court opinion was so wrong that the Court can decide the case on the merits without briefing or oral argument); or that one or more Justices are writing a dissent from the decision to deny review.

Not knowing how the SCOTUS works...it seems a number of those cases are very similar with there being about 3 themes represented within that group of 10. Would the SCOTUS combine cases into a single decision or select 1 as representative and rule on it with that ruling acting as the guiding rule?

While we should note that SCOTUS can do whatever it wishes (more or less), the typical practice would be to select one case for oral argument and hold the others. Depending on the outcome, all others either would be remanded for further proceedings in a lower court "consistent with the opinion" of the decided case or their petitions would be denied if the outcome doesn't change their probable outcome. In rare cases, cases arguing the same thing (challenging the same law, not similar ones) may be combined if there is good reason. This is relatively rare.

 

It is very common to see cases relisted many times before they decided whether a case is to be heard. At this point in the term, any case accepted would be argued in the fall.

 

We just have to wait and see.

They would likely take 1 case, decide it, and send the rest back to the lower courts with instructions to look at the case just decided. There are 3 NJ carry cases however. Those could possibly be consolidated since it's the same law being challenged.

The cases still haven't been relisted as of yet. It's looking like no conference tomorrow.

I'm reading this and I can't figure out what is off topic. He is spot on. :ermm:

By all accounts Kavanaugh and Gorsuch are pushing for the court to hear 2A cases. I can't figure out what people are complaining about? It's not them who are holding things up. And holy smokes, are there people who actually think Hillary's justices would have fought for the 2A?
