So I placed an order for some S&W 17 Round Magazines the other day from Joe Bob Outfitters. Today I received this message from Joe Bob's....

"As your probably aware, high capacity magazines are restricted in Cook County. You'll need to submit a copy of your LEO/MIL credentials before we can ship your order, If you are exempt from these restrictions." To make it worse they charged my a 15% restocking fee.

I thought....Illinois law preempts any local handgun legislation. There is no magazine limit for licensed handgun concealed carriers under Illinois law."

Am I wrong?

You're right, for what its worth. However as many have discovered our actual laws have very little if nothing to do with stores policies on shipping. Especially when you live in Cook County.

They don't care that CCL holders are not bound by any magazine restrictions that Cook County may have. Their policy is gonna be a blanket ban on all sales to Cook County of whatever item.

That really does stink if they just recently changed that policy though. I would for sure dispute the charges on my credit card. Let them pay their own restocking fee.

Actually it's anyone with an FOID and/or CCL- but only for handguns.

Ones interpretation of this:

 

430 ILCS 66/90)

 

Sec. 90. Preemption. The regulation, licensing, possession, registration, and transportation of handguns and ammunition for handguns by licensees are exclusive powers and functions of the State. Any ordinance or regulation, or portion thereof, enacted on or before the effective date of this Act that purports to impose regulations or restrictions on licensees or handguns and ammunition for handguns in a manner inconsistent with this Act shall be invalid in its application to licensees under this Act on the effective date of this Act. This Section is a denial and limitation of home rule powers and functions under subsection (h) of Section 6 of Article VII of the Illinois Constitution.

Here we are trying to fight off a mag ban, while retailers assume that there is a ban in place... Wow!

 

If you ran a business and say $100 of your merchandise was "confiscated", how long would it take to stop sending your merchandise to that area? I don't like it but I understand it.

 

I understand that, I bought G17 mags from them before, I think it might be a new policy....I will still shop at Joe Bob Outfitters I really like them plus they ship really fast.
