RANDY Posted October 23, 2012 at 08:19 PM Share Posted October 23, 2012 at 08:19 PM They are talking about the plantiffs (SAF/Ezell) missing a status hearing on 10/9/12 at the northern district court, which cancelled a discovery hearing yesterday. The judge presiding over the discovery phase change on the first of the month due to the prior judge retiring on the first also.
Molly B. Posted October 23, 2012 at 10:16 PM Share Posted October 23, 2012 at 10:16 PM Looks like the district judge granted a joint motion for additional time for discovery and scheduled a hearing for October 9. That was back on August 13. In the interim, the defendants (Chicago) made a motion for additional time for expert discovery, which was unopposed and granted. The court’s order granting that motion canceled a hearing that had been scheduled (on that motion) in September. The October 9 hearing remained on the calendar. On October 1 there was a new magistrate judge assigned. (Magistrates generally oversee discovery matters and other “lesser” pretrial issues.) The magistrate judge scheduled a hearing for October 22. When the district judge made a docket entry a few days later on October 10 that the previous day’s hearing had been missed, the magistrate judge then canceled the 10/22 hearing. ming Posted October 23, 2012 at 10:34 PM Share Posted October 23, 2012 at 10:34 PM Could someone explain what this means for the case. I'm not sure what is going on here.
Molly B. Posted October 23, 2012 at 10:38 PM Share Posted October 23, 2012 at 10:38 PM I think with the request by both sides for more discovery time and a new judge being assigned it means the Oct. hearings will take place in Nov. or Dec. probably. Molly B. Posted October 24, 2012 at 07:30 PM Share Posted October 24, 2012 at 07:30 PM I have confirmed that there is no problem. Everything is proceeding according to plans, expert witnesses are in the process of being deposed.
