Misdemeanor gun charges in Chicago?

Why would he be charged with misdemeanors for the aggravated assault with a deadly weapon and possession without a valid FOID card? Aren't these charges felonies?

It could have been an expired FOID card, or a first offense for possession if he was otherwise eligible for a FOID. Either of those is a Class A.

With 3 attempted murder charges and a felony aggravated discharge, that's going to be the least of his worries.

On 5/25/2017, Superintendent Eddie Johnson predicted a 50% reduction is Chicago violence within 3 years of SB1722 becoming law.  The bill was signed into law on 6/23/2017. The clock is now ticking.

They were just piling everything on they could think of. No different from someone who gets arrested for felony aggravated fleeing and eluding also getting charged with failing to wear a seatbelt.

Hes screwed anyway but i thought any illegal gun possession was a felony? I was charged with agg. uuw for my offense and I never pointed it or was in possession while committing a crime. The states attorney must be a frequent customer at his daddy's lemonade stand.

There are ways it can be a felony under the FOID Act, and also under UUW and AUUW. It depends on the circumstances of the possession.

These are also booking charges. IDK about Chicago, but around here they usually book people on obvious minimum stuff for holding purposes. The SA can and almost definitely will upgrade some, drop others.

I know someone pulled over with over a 1/2 pound of pot in baggies (making deliveries) and a firearm with no FOID, two misdemeanors no lawyer and he was slightly inconvenienced, even the court costs weren't that much.    We have entire cities that have chosen to ignore federal laws why should we expect the people to be any different?

Gang affiliation gets you off with a lighter sentence. He'll be out in 13 months maximum.

 

 

Seriously though, I know of someone (non gang banger) who was illegally carrying a loaded firearm, per the letter of the law. He was charged with misdemeanor illegal transport of a firearm.

Rumor has it that the CCSAO is not charging weapons violations, if you have a foid. They are worried about being sued for abuse of process..
