(720 ILCS 5/24-1.5) Sec. 24-1.5. Reckless discharge of a firearm. (a) A person commits reckless discharge of a firearm by discharging a firearm in a reckless manner which endangers the bodily safety of an individual. ( If the conduct described in subsection (a) is committed by a passenger of a moving motor vehicle with the knowledge and consent of the driver of the motor vehicle the driver is accountable for such conduct. © Reckless discharge of a firearm is a Class 4 felony. (d) This Section does not apply to a peace officer while in the performance of his or her official duties. I think a football player in New York got 5 years in prison for doing that in a bar. Your lacking a lot of particulars. As a legal gun owner lawfully in possession of the firearm, generally no. If you shot yourself and kill yourself it is not a crime. A dead person cannot be charged with a crime because he has no ability to defend himself in a court of law. Rule 43 provides that a defendant shall be presentat the arraignment,at the time of the plea,at every stage of the trial including the impaneling of the jury and the return of the verdict andat the imposition of sentence. While all "accidental" discharges involve negligence, I would venture that some do not meet the standard for reckless (720 ILCS 5/24-1.5). In addition, depending on the 2a opinion of the county district attorney, many would not charge with a crime unless there were aggravating circumstances.
