Yesterday in the House, HR1001 Memorial - Otis McDonald was filed, mourning the death of a true patriot.

 

 

In House committee, HA1 to HB4860 Criminal Law Tech was approved.

And, in its typical illogical nature, the Illinois Council Against Handgun Violence stood in firm opposition to HB4849 HFA1, an amendment designed to facilitate the acquisition of firearms and ammunition by military personnel stationed in Illinois.




The House and Senate are scheduled for 10:00 AM..

HB4754 Crim Cd 3D Firearms Prohibits

Synopsis As Introduced

Amends the Criminal Code of 2012. Creates the offense of unlawful use of a three-dimensional printer to create a firearm. Provides that a person commits the offense when he or she uses a three-dimensional printer to create a firearm, or any piece or part of a firearm, unless the person possesses a license to manufacture firearms under the federal Gun Control Act of 1968. Provides that a violation is a Class A misdemeanor.

House Committee Amendment No. 1

Exempts from a violation, a person actually engaged in the business of manufacturing and selling any piece or part of a firearm to a person who possesses a license to manufacture firearms under the federal Gun Control Act of 1968, but only with respect to the activities which are within the lawful scope of that business.

House Floor Amendment No. 2 - Pending

Replaces everything after the enacting clause. Amends the Criminal Code of 2012. Reinserts the provisions of the bill, except adds exemption for a person who uses a three-dimensional printer to create a non-functioning prototype of a firearm. Requires that the person must knowingly use a three-dimensional printer to create a fully functioning firearm. Retains exemption for a person who possesses a license to manufacture firearms under the federal Gun Control Act of 1968. Deletes the amendatory changes made by House Amendment 1 and that the offense applies to creating a part of a firearm.


House Floor Amendment No. 3 - Lost in Committee 4/3/2014

Replaces everything after the enacting clause. Amends the Criminal Code of 2012. Reinserts the provisions of the bill, as amended, except provides that a three-dimensional printer is a computer (rather than a computer-driven machine). Adds exemption for a person who uses a three-dimensional printer to create a prototype of a firearm. Requires that the person must knowingly use a three-dimensional printer to create a fully functioning firearm. Retains exemption for a person who possesses a license to manufacture firearms under the federal Gun Control Act of 1968. Deletes provision that the person is actually engaged in the business of manufacturing and selling any piece or part of a firearm must sell it to a person who possesses a license to manufacture firearms under the federal Gun Control Act of 1968. Adds definition of "prototype".

House Floor Amendment 1 - Pending

Replaces everything after the enacting clause. Amends the Criminal Code of 2012. Provides that after the disposition of a criminal case or in any criminal case where a final judgment in the case was not entered due to the death of the defendant, and when a confiscated weapon is no longer needed for evidentiary purposes, and when in due course no legitimate claim has been made for the weapon, a weapon transferred to a law enforcement agency may be sold by the law enforcement agency at public auction under the Law Enforcement Disposition of Property Act. Amends the Domestic Violence: Order of Protection Article of the Code of Criminal Procedure of 1963 and the Illinois Domestic Violence Act of 1986. Provides that upon expiration of the period of safekeeping of a firearm of a respondent against whom an order of protection was issued, if the firearms or Firearm Owner's Identification Card cannot be returned to respondent because the respondent cannot be located, fails to respond to requests to retrieve the firearms, or is not lawfully eligible to possess a firearm, upon petition from the local law enforcement agency, the court may order the local law enforcement agency to sell the firearm at public auction under the provisions of the Law Enforcement Disposition of Property Act. Amends the Law Enforcement Disposition of Property Act. Provides that weapons that have been confiscated as a result of having been abandoned or illegally possessed may be sold at public auction under the Act.

Defines "tactical paramedic".

SB3538 Crim Cd Trespass State Support

Amends the Criminal Code of 2012. Provides that a person also commits criminal trespass to State supported land when he or she enters upon land owned, leased, or otherwise used by a public body or district organized under the Metropolitan Transit Authority Act, the Local Mass Transit District Act, or the Regional Transportation Authority Act, after receiving, prior to the entry, notice from the public body or district, or its representative, that the entry is forbidden, or remains upon the land or in the building after receiving notice from the public body or district, or its representative, to depart and, in doing so, causes a delay in transit service lasting more than 15 minutes or compromising public safety. Provides that a first violation is a Class 4 felony and a second or subsequent violation is a Class 3 felony.


Senate Committee Amendment No. 1

Replaces everything after the enacting clause. Amends the Criminal Code of 2012. Senate Floor Amendment 2

Replaces everything after the enacting clause. Reinserts the provisions of the bill as amended. Limits the offense to those who enter upon the forbidden part of a right of way, including facilities and improvements thereon (rather than land) of the transportation facility with the intent to compromise public safety by causing a delay in transit service lasting more than 15 minutes or destroying property. Defines "right of way".

Ms. Williams asks Mr Durkin for a definition of the term "curtilage". Mr. Dunkin cites case law established by SCOTUS and relates that to the definition in the bill.

Ms. Williams wonders why this has never been challenged in the past.

Mr. Durkin relates that it was challenged and that People v Layton was incorporated into the bill.

Ms. Williams appears to oppose the bill based on a personality conflict rather than the language.
