According to court records, Pritzker is facing what is known as an "Indirect Civil Contempt Motion" in connection with a lawsuit filed by State Rep. Darren Bailey in Clay County.

Press Secretary Jordan Abudayyeh said the issuance of the order without allowing the governor an opportunity to respond to the motion "is procedurally improper" and violated "elementary principles of fairness."

The motion filed by Bailey accuses the governor of ignoring prior orders by the court, and says he should be held in contempt for continuing to issue executive orders in connection to the ongoing coronavirus pandemic.

 

The motion seeks to have Pritzker held in contempt of court, and to be imprisoned in the Clay County Jail "until he purges himself by rescinding the above-mentioned executive orders."

So the headline should really be "Darren Bailey asks judge to find Pritzker in contempt." By ordering a governor to appear, instead of to file a brief or some other response, the judge may have overplayed his hand this time. An error in procedure seems like the kind of thing a governor could order an AG to quash in the state supreme court.

Of course not, can’t have “one of our own” taken down by a mere formality.

Would the Illinois “supreme” court intervene on any peasants case like this?

The Illinois Supreme Court has declined to consider a downstate legal battle over Gov. J.B. Pritzker’s coronavirus-related orders and moved the case to Sangamon County. It’ll be consolidated with a similar case. The move comes as the first-term Democrat was expected in a Clay County courtroom this week.
