Skipper7 Posted January 9, 2021 at 07:44 PM Share Posted January 9, 2021 at 07:44 PM Hello all. Looking for some clarification I couldnt find on the ISP website. I have a FOID card, own a weapon and an home from school. I currently dont have car insurance because I go to school out of state. Assuming all other rules are followed, can someone who doesnt have a FOID card drive a car with my gun in it given that I am in the passenger seat and have my FOID? Does this change if the driver is a minor?
101abn Posted January 9, 2021 at 07:53 PM Share Posted January 9, 2021 at 07:53 PM I would transport under foid rules, preferably in the trunk if applicable, otherwise well out of reach of the driver. make sure the driver is never alone in the car. If any part of what i stated is wrong im sure someone will correct. Enjoy your stay.........
mauserme Posted January 9, 2021 at 08:01 PM Share Posted January 9, 2021 at 08:01 PM As long as you are legally in possession of the firearm, neither ownership of the vehicle nor age of the driver enter into it while you're in Illinois. If you're traveling to another state, say if the driver is taking you back to an out-of-state school, you'll have to check those state's laws as well. NRApistol Posted January 9, 2021 at 08:05 PM Share Posted January 9, 2021 at 08:05 PM What if I leave a firearm in my vehicle (regardless of location) and someone without a FOID card is driving the vehicle and is stopped by police and the firearm is found? The law states a person must “knowingly” violate the law. The assumption in the question is that the driver was unaware of a firearm’s presence. However, at a traffic stop, you should expect the officer to handle the situation at face value, take enforcement action accordingly, and let the court settle the matter. Don’t put someone in that position.
